【摘要】：隨著金融市場(chǎng)的創(chuàng)新,尤其是我國(guó)推出融資融券的股票交易方式,創(chuàng)立股指期貨市場(chǎng)和創(chuàng)業(yè)板市場(chǎng)后,投資者適當(dāng)性制度開(kāi)始在資本市場(chǎng)逐步建立并引起關(guān)注。解讀我國(guó)的投資者適當(dāng)性制度并進(jìn)行一定的國(guó)際比較,可以發(fā)現(xiàn),投資者適當(dāng)性制度主要由投資者識(shí)別、分類(lèi)、確認(rèn)以及風(fēng)險(xiǎn)揭示等規(guī)則構(gòu)成。但是,該制度的缺陷也十分突出,主要表現(xiàn)在:剝奪了部分投資者的公平投資機(jī)會(huì)、投資者風(fēng)險(xiǎn)承受能力的評(píng)判標(biāo)準(zhǔn)失當(dāng)、適當(dāng)性制度的義務(wù)主體不明確且法律責(zé)任規(guī)定不具體,這些缺陷限制了該制度的發(fā)展,需要進(jìn)一步修正、完善。
[Abstract]:With the innovation of the financial market, especially the introduction of the stock trading mode of margin financing, the establishment of stock index futures market and gem market, the investor suitability system has been gradually established in the capital market and attracted attention. By analyzing the system of investor appropriateness in our country and comparing it with other countries, we can find that the system of investor appropriateness is mainly composed of the rules of investor identification, classification, confirmation and risk disclosure. However, the defects of the system are also very prominent, mainly in the following aspects: some investors are deprived of their fair investment opportunities, and their risk bearing capacity is judged by improper criteria. The obligation subject of the appropriateness system is not clear and the legal liability regulation is not specific. These defects limit the development of the system and need to be further revised and perfected.
