【摘要】：中國建立國際金融中心以及改善法制環(huán)境的目的在于取得國際金融監(jiān)管體系變革中的話語權,以保障國家的金融安全與經(jīng)濟的可持續(xù)發(fā)展。這一戰(zhàn)略目標通過何種路徑得以實現(xiàn)是亟需解決的理論問題。為此,有必要借鑒國際金融法律環(huán)境與監(jiān)管制度的理論,結合中國現(xiàn)狀提出有針對性的政策與立法建議。本文通過考察"功能理論"與"支配理論"的內(nèi)涵及其應用,結合中國特殊的經(jīng)濟地位,認為"功能理論"可為構建完備的金融監(jiān)管體制與國際合作機制提供可行、合理的結構圖;"支配理論"可為中國取得國際金融監(jiān)管事務的話語權、保障金融安全、完善法制環(huán)境提供較為全面的路線圖。在此基礎上,本文就中國獲得相關領域的話語權提出了具體的政策與立法建議。
[Abstract]:The purpose of establishing an international financial center and improving the legal environment in China is to gain the right to speak in the reform of the international financial supervision system, so as to ensure the national financial security and the sustainable development of the economy. How to achieve this strategic goal is a theoretical problem that needs to be solved. Therefore, it is necessary to draw lessons from the theories of international financial legal environment and supervision system, and put forward targeted policy and legislative suggestions combined with the current situation of China. By examining the connotation and application of "function theory" and "domination theory" and combining with China's special economic status, this paper holds that "function theory" can provide a feasible way to construct a complete financial supervision system and international cooperation mechanism. The theory of domination can provide a more comprehensive road map for China to obtain the right to speak on international financial supervision affairs, to ensure financial security and to perfect the legal environment. On this basis, this paper puts forward specific policy and legislative suggestions for China to gain the right to speak in related fields.
