【摘要】：美國(guó)在金融產(chǎn)品消費(fèi)者保護(hù)領(lǐng)域有著較為完備的法律體系,但該保護(hù)體系在次貸危機(jī)中仍暴露出明顯問(wèn)題,金融產(chǎn)品消費(fèi)者在危機(jī)中依然遭受了很大損失。因此,強(qiáng)化消費(fèi)者保護(hù)被確認(rèn)為美國(guó)金融監(jiān)管改革的一項(xiàng)重要內(nèi)容。本文從市場(chǎng)失靈和行為金融學(xué)角度剖析了金融消費(fèi)者保護(hù)失效的根源,對(duì)國(guó)外金融監(jiān)管體系的改革進(jìn)展進(jìn)行了深入研究,并結(jié)合實(shí)際提出了建設(shè)我國(guó)金融消費(fèi)者保護(hù)體系的具體措施。
[Abstract]:The United States has a relatively complete legal system in the field of consumer protection of financial products, but the protection system still exposes obvious problems in the subprime mortgage crisis, and the consumers of financial products still suffer great losses in the crisis. Therefore, strengthening consumer protection has been recognized as an important part of financial regulatory reform in the United States. This paper analyzes the root causes of the failure of financial consumer protection from the perspective of market failure and behavioral finance, and makes a thorough study on the reform progress of foreign financial supervision system. Combined with the actual situation, the author puts forward the concrete measures to build the financial consumer protection system in China.
