【摘要】：在中國(上海)自由貿(mào)易區(qū)金融創(chuàng)新步伐加快的背景下,我國應(yīng)收賬款轉(zhuǎn)讓融資"未決"法律問題將使得自由貿(mào)易區(qū)涉外應(yīng)收賬款轉(zhuǎn)讓融資糾紛的解決變得更加復(fù)雜。本文對應(yīng)收賬款轉(zhuǎn)讓融資中的應(yīng)收賬款雙(多)重融資的性質(zhì)及效力、應(yīng)收賬款債權(quán)禁止轉(zhuǎn)讓條款約束力、應(yīng)收賬款債權(quán)轉(zhuǎn)讓通知主體及總通知約束力、未來應(yīng)收賬款債權(quán)轉(zhuǎn)讓效力等"未決"法律問題進(jìn)行探討。
[Abstract]:Under the background of speeding up the pace of financial innovation in China (Shanghai) Free Trade area, the legal problem of "outstanding" transfer financing of accounts receivable in China will make the settlement of financing disputes concerning the transfer of foreign accounts receivable more complicated. This paper deals with the nature and effectiveness of double (multiple) refinancing of accounts receivable in transfer financing of accounts receivable, the binding force of non-transferable clauses of accounts receivable creditor's rights, the subject of the transfer notice of accounts receivable creditor's rights and the binding force of the total notice. In the future, the validity of transfer of accounts receivable creditor's rights and other outstanding legal issues are discussed.
