【摘要】：汽車產(chǎn)業(yè)是我國的主導(dǎo)產(chǎn)業(yè)，對(duì)我國國民經(jīng)濟(jì)發(fā)展具有重要的推動(dòng)作用。政府的有效監(jiān)管，直接關(guān)系到產(chǎn)業(yè)的未來，乃至國家經(jīng)濟(jì)利益。近年來，隨著汽車保有量的逐步攀升，汽車行業(yè)一方面面臨高速增長(zhǎng)的機(jī)遇和巨大的市場(chǎng)潛力；另一方面面臨嚴(yán)重的信譽(yù)危機(jī)。近幾年新聞媒體頻頻曝出汽車零部件、輔助材料、整車及售后等出現(xiàn)的一系列問題，導(dǎo)致消費(fèi)者權(quán)益得不到保障。由于維權(quán)道路艱難，部分消費(fèi)者采取不恰當(dāng)?shù)木S權(quán)方式，不僅使自己的經(jīng)濟(jì)利益受損，同時(shí)也影響了社會(huì)的穩(wěn)定和諧。筆者認(rèn)為，政府監(jiān)管乏力是導(dǎo)致汽車行業(yè)面臨嚴(yán)重信譽(yù)危機(jī)的主要原因。因此，我們必須高度重視政府監(jiān)管對(duì)行業(yè)發(fā)展的影響。目前我國汽車行業(yè)政府監(jiān)管存在諸多問題：（１）零部件及輔助材料使用的政府監(jiān)管缺位；（２）政府難以保障消費(fèi)者的知悉權(quán)，導(dǎo)致消費(fèi)者利益受損；（３）政府對(duì)汽車銷售、售后市場(chǎng)監(jiān)管薄弱。由此可以看出，汽車行業(yè)政府監(jiān)管問題絕不是一個(gè)孤立的問題，必須結(jié)合汽車生產(chǎn)、銷售、售后等領(lǐng)域進(jìn)行全方位的系統(tǒng)分析與研究。因此，政府應(yīng)該從汽車制造源頭到售后服務(wù)逐個(gè)環(huán)節(jié)進(jìn)行監(jiān)管，構(gòu)建我國汽車行業(yè)政府監(jiān)管體系的總體框架。 本文首先從政府規(guī)制的一般理論及政府職能的相關(guān)理論出發(fā)，，為探討我國汽車行業(yè)監(jiān)管研究提供相應(yīng)的理論基礎(chǔ)。本研究針對(duì)我國汽車行業(yè)政府監(jiān)管存在的諸多問題，從監(jiān)管法規(guī)、監(jiān)管機(jī)制、監(jiān)管部門職責(zé)分工、監(jiān)管模式等方面進(jìn)行了闡述，并深入分析其成因。嘗試在借鑒國內(nèi)外相關(guān)學(xué)者研究成果及觀點(diǎn)經(jīng)驗(yàn)的基礎(chǔ)上，比較分析我國的汽車行業(yè)政府監(jiān)管與美、日兩國政府監(jiān)管的差異，找出我們的不足之處。將我國汽車行業(yè)的特點(diǎn)與國情相結(jié)合，提出相應(yīng)的對(duì)策和建議，意在建立多層次、多主體參與的現(xiàn)代汽車行業(yè)監(jiān)管體系。這將為切實(shí)維護(hù)我國國家利益、消費(fèi)者權(quán)益以及促進(jìn)我國汽車行業(yè)健康發(fā)展提供保障。
[Abstract]:The automobile industry is the leading industry of our country, which plays an important role in promoting the development of our national economy. The effective supervision of the government is directly related to the future of the industry and even the national economic interests. On the one hand, the automobile industry is facing high growth opportunities and huge market potential; on the other hand, it faces a serious credit crisis. In recent years, the news media have frequently exposed a series of problems, such as automobile parts, auxiliary materials, complete vehicles and after-sales, etc. As a result of the difficult road of safeguarding the rights and interests of consumers, some consumers not only hurt their economic interests, but also affected the stability and harmony of the society by adopting inappropriate ways of safeguarding their rights. Weak government regulation is the main reason why the auto industry is facing a serious credit crisis. We must attach great importance to the impact of government regulation on the development of the industry. At present, there are many problems in the government regulation of the automobile industry in our country. At present, there are many problems in government supervision of the use of spare parts and auxiliary materials. (2) the government is unable to protect the right of consumers to know. The government has weak supervision over auto sales and the after-sale market. From this, we can see that the issue of government regulation in the automobile industry is by no means an isolated issue, it must be combined with automobile production and sales. Therefore, the government should supervise from the source of automobile manufacturing to after-sale service one by one, and construct the overall frame of government supervision system of automobile industry in our country. This paper starts from the general theory of government regulation and the relevant theory of government function, and provides the corresponding theoretical basis for the research on the regulation of automobile industry in China. This study aims at many problems existing in the government supervision of automobile industry in China. From the aspects of regulation law, supervision mechanism, division of responsibilities of supervision department, supervision mode and so on, this paper expounds the causes of the regulation, and tries to draw lessons from the research results and views of relevant scholars at home and abroad, on the basis of the experience of the relevant scholars at home and abroad. This paper compares and analyzes the differences between the government supervision of automobile industry in our country and that of the United States and Japan, finds out our shortcomings, combines the characteristics of our automobile industry with the national conditions, and puts forward corresponding countermeasures and suggestions in order to establish a multi-level system. The supervision system of modern automobile industry with multi-subject participation will provide the guarantee for safeguarding our country's national interests, consumers' rights and interests and promoting the healthy development of China's automobile industry.
