網(wǎng)絡(luò)海外代購監(jiān)管法律制度研究
[Abstract]:Under the background of the rapid development of electronic commerce and the accelerating process of economic globalization, online purchasing as a new economic form is favored by domestic consumers as a new economic form. From the professional overseas purchase website to the "WeChat circle", there are network overseas purchasing activities. The development trend of the industry has brought great convenience to the consumers of our country and made great contributions to the market economy of our country. Meanwhile, it also brought great challenges to the legal system of network oversea purchasing supervision in China. The overseas purchasing consumers are faced with many transaction risks, and the existence of information asymmetry in the online purchase market makes the consumer's rights and interests not guaranteed. On the other hand, the online purchase market is in a disorderly state, which is not only disadvantageous to the development of the market potential of the network overseas, but also hinders the network. The overseas purchase and purchase economy is sustainable, stable and healthy. The laws and regulations of oversea purchasing supervision in China are not blank. However, there are many shortcomings in the supervision system, the system of admittance supervision, the system of credit supervision and the safety supervision system. On the other hand, it has become an urgent problem to create a good trading environment for the online purchase of consumers overseas and provide a healthy development environment for the network overseas buying and buying. This article is divided into four parts, in addition to the introduction and conclusion: the first part is the network overseas. This part first defines the concept of Internet oversea purchasing and online oversea purchasing supervision, and then makes a clear overview of the oversea purchasing supervision of the network. Finally, it analyzes the significance of improving the legal system of oversea purchasing supervision in China. The second part is the network overseas purchase. The theoretical basis and basic principles of supervision. This part, first of all, combined with the specific background of China's network overseas purchase and purchase, expounds the economic basis and legal basis of the network oversea purchasing supervision, and then makes clear the value orientation and basic principles of the network oversea purchasing supervision, in order to improve our network overseas purchase. The third part is the investigation and analysis of the current status of the legal system of oversea purchasing supervision in China. This part is based on the supervision system of oversea purchasing supervision, the supervision system, the credit supervision system, the security supervision system, and the analysis of the specific regulatory legal system of the network oversea purchase. The fourth part is the perfect path for the legal system of network oversea purchasing supervision in China. Under the guidance of the value orientation and basic principles of the network oversea purchasing supervision, this part is on the basis of analyzing the shortcomings of the legal system of oversea purchasing supervision in China, and in the effective study of foreign advanced countries. On the premise of the practice, we finally put forward the perfect route for the legal system of oversea purchasing supervision in China from four aspects, which include: perfecting the system of oversea purchasing supervision, supervising system of overseas purchase and admittance, supervising system of overseas purchase and purchase, and supervising system of overseas purchase and purchase.
