【摘要】:經(jīng)濟(jì)勢(shì)態(tài)若要保持健康平穩(wěn)增長(zhǎng),離不開(kāi)支付體系的完善健全。隨著互聯(lián)網(wǎng)推動(dòng)的電子商務(wù)的進(jìn)步,與之相協(xié)調(diào)的第三方支付機(jī)構(gòu)異軍突起,在電商平臺(tái)乃至線下市場(chǎng)的擴(kuò)張規(guī)模都以驚人速度發(fā)展,支付機(jī)構(gòu)代為保管的客戶資金數(shù)額也日漸增加。目前,全國(guó)境內(nèi)已有超過(guò)270家第三方支付機(jī)構(gòu)獲得央行頒發(fā)的第三方支付牌照,這些機(jī)構(gòu)有著特殊的類金融機(jī)構(gòu)性質(zhì),他們的快速發(fā)展,對(duì)于繁榮支付市場(chǎng)、方便公眾資金結(jié)算來(lái)說(shuō)無(wú)疑是巨大的推動(dòng)力量。第三方支付機(jī)構(gòu)作為互聯(lián)網(wǎng)金融行業(yè)的重要角色,目前已發(fā)展得十分壯大,關(guān)乎著國(guó)家經(jīng)濟(jì)的安全與穩(wěn)定。但由于目前對(duì)第三方支付企業(yè)仍缺乏全面的法律規(guī)范體系,監(jiān)管的滯后極易造成用戶直接經(jīng)濟(jì)損失,甚至威脅到我國(guó)的金融安全,所以在當(dāng)下逐步形成完善健全的支付機(jī)構(gòu)法律監(jiān)管體系,已是勢(shì)在必行。作為法學(xué)學(xué)科中的理論源泉,法理學(xué)研究的是法律現(xiàn)象以及法的本質(zhì)中的普遍規(guī)律,為各個(gè)部門法學(xué)提供了原則性的理論支撐。若要構(gòu)建一個(gè)完整的第三方支付法律體系,僅僅從某一部門法出發(fā)是不夠的,必須站在法理學(xué)的高度來(lái)全盤把握、宏觀研究。本文將第三方支付平臺(tái)所屬的部門法與法理學(xué)相融合,首先對(duì)第三方支付平臺(tái)予以定位,并以第三方支付機(jī)構(gòu)的健康發(fā)展為出發(fā)點(diǎn),剖析支付業(yè)務(wù)過(guò)程中的法律特征和法律關(guān)系,分析借鑒歐美等發(fā)達(dá)國(guó)家和地區(qū)對(duì)第三方支付機(jī)構(gòu)的立法經(jīng)驗(yàn),結(jié)合我國(guó)的立法現(xiàn)狀,總結(jié)出目前我國(guó)的第三方支付機(jī)構(gòu)發(fā)展過(guò)程中,監(jiān)管層面所暴露的若干問(wèn)題和不足之處,并試著提出解決意見(jiàn),即提高第三方金融機(jī)構(gòu)支付服務(wù)的法律位階,完善配套的法律體系,加強(qiáng)對(duì)交易中備付金的監(jiān)管,為第三方支付機(jī)構(gòu)的健康發(fā)展創(chuàng)造法治環(huán)境,為打造一個(gè)愈發(fā)高效便捷的支付市場(chǎng)而努力。
[Abstract]:If the economic situation is to maintain healthy and steady growth, the payment system can not be perfect and sound. With the progress of electronic commerce promoted by the Internet, the third party payment organizations that coordinate with it have suddenly emerged, and the scale of expansion in e-commerce platforms and even offline markets has developed at an astonishing speed. Payment institutions on behalf of the custody of customer funds are also increasing. At present, more than 270 third-party payment institutions in the country have been granted third-party payment licenses issued by the Central Bank. These institutions have a special nature of financial institutions. Their rapid development has contributed to the prosperity of the payment market. To facilitate the settlement of public funds is undoubtedly a huge driving force. As an important role in the Internet financial industry, third-party payment institutions have developed very strongly, which is related to the security and stability of the national economy. However, due to the lack of a comprehensive legal and normative system for third-party payment enterprises at present, the delay in supervision can easily cause direct economic losses to users and even threaten the financial security of our country. Therefore, it is imperative to gradually form a sound legal supervision system of payment institutions at present. As the theoretical source of the subject of law, jurisprudence studies the legal phenomena and the universal laws in the nature of law, which provides the theoretical support of principle for each department of jurisprudence. If we want to construct a complete third party payment legal system, it is not enough to just start from a certain branch of law, we must hold it from the height of jurisprudence and study macroscopically. In this paper, the law of third-party payment platform is combined with jurisprudence. Firstly, the third-party payment platform is positioned, and the healthy development of third-party payment institution is taken as the starting point. This paper analyzes the legal characteristics and legal relations in the process of payment business, analyzes the legislative experience of developed countries and regions such as Europe and the United States on third-party payment institutions, and combines the current legislative situation of our country. This paper summarizes some problems and deficiencies in the development of third-party payment institutions in China, and tries to put forward some suggestions, that is, to improve the legal rank of payment services of third-party financial institutions. Improve the supporting legal system, strengthen the regulation of the provisions in the transaction, create a legal environment for the healthy development of third-party payment institutions, and strive to create a more efficient and convenient payment market.
