【摘要】:隨著社會(huì)經(jīng)濟(jì)的發(fā)展,帶動(dòng)社會(huì)科學(xué)技術(shù)的發(fā)展,電子行業(yè)的發(fā)展越發(fā)蓬勃,隨之而來(lái)的各類(lèi)電子商務(wù)不斷進(jìn)入人們的日常生活。支付寶、財(cái)付通等各類(lèi)第三方支付平臺(tái)的出現(xiàn)帶來(lái)了當(dāng)前社會(huì)消費(fèi)支付方式的新發(fā)展。而第三方支付平臺(tái)與人們的日常生活都有著極大的關(guān)系,能夠?qū)θ藗兊娜粘I顜?lái)巨大影響,隨著第三方支付的影響力的不斷加大,第三方支付企業(yè)獲得準(zhǔn)金融機(jī)構(gòu)的經(jīng)濟(jì)及政策地位,與商業(yè)銀行、電信、移動(dòng)運(yùn)營(yíng)商等企業(yè)共同提供面向機(jī)構(gòu)和個(gè)人用戶的電子支付服務(wù)。盡管第三方支付作為當(dāng)前甚至未來(lái)的很長(zhǎng)一段時(shí)間內(nèi),電子產(chǎn)業(yè)發(fā)展的一大主流,然而目前第三方支付中由于市場(chǎng)的不規(guī)范性、資金沉淀、消費(fèi)者法律意識(shí)缺失以及缺乏完善的法律制度的監(jiān)管等等,必然會(huì)帶來(lái)第三方支付在發(fā)展過(guò)程中存在重大的風(fēng)險(xiǎn)。而上述各類(lèi)風(fēng)險(xiǎn)的存在,必然會(huì)導(dǎo)致第三方支付產(chǎn)業(yè)的發(fā)展出現(xiàn)隱患,對(duì)消費(fèi)者的切身利益以及企業(yè)的發(fā)展甚至我國(guó)的整個(gè)經(jīng)濟(jì)社會(huì)的發(fā)展造成切身的傷害,危機(jī)我國(guó)經(jīng)濟(jì)市場(chǎng)的穩(wěn)定性。要對(duì)第三方支付產(chǎn)業(yè)的風(fēng)險(xiǎn)進(jìn)行規(guī)避、解決,最有效且強(qiáng)制的手段就是對(duì)相關(guān)的法律環(huán)境進(jìn)行改造,從法律層面直接改變目前第三方支付平臺(tái)不完善的法律監(jiān)管制度,維護(hù)我國(guó)經(jīng)濟(jì)社會(huì)的穩(wěn)定發(fā)展。隨著第三方支付產(chǎn)業(yè)的飛速發(fā)展,我國(guó)立法機(jī)關(guān)已經(jīng)認(rèn)識(shí)到了法律監(jiān)管的重要性,出臺(tái)了一些基本的法律對(duì)第三方支付產(chǎn)業(yè)進(jìn)行監(jiān)管。然而,起步比較晚的國(guó)內(nèi)第三方支付平臺(tái)的法律制度相對(duì)國(guó)外發(fā)達(dá)國(guó)家而言,有著極大的不完善性。本文針對(duì)美國(guó)、歐盟、日本等對(duì)第三方支付產(chǎn)業(yè)監(jiān)管較為完善的國(guó)家及地區(qū),研究其優(yōu)秀的法律監(jiān)管經(jīng)驗(yàn),總結(jié)我國(guó)第三方支付產(chǎn)業(yè)在各個(gè)方面的不足之處,針對(duì)性的提出解決對(duì)策,更好的發(fā)展我國(guó)第三方支付產(chǎn)業(yè)。
[Abstract]:With the development of social economy and the development of social science technology, the development of electronic industry is more and more vigorous. The emergence of various third-party payment platforms such as Alipay, Tenpay and so on has brought about the new development of social consumption payment. The third-party payment platform has a great relationship with people's daily life, which can bring great influence to people's daily life, with the increasing influence of third-party payment. Third-party payment enterprises acquire the economic and policy status of quasi-financial institutions, and work with commercial banks, telecommunications, mobile operators and other enterprises to provide electronic payment services for both institutional and individual users. Although third-party payment is a major trend in the development of the electronic industry for a long time at present or even in the future, at present, due to the market irregularity, the funds are precipitated in third-party payment. The lack of legal consciousness of consumers and the lack of supervision of perfect legal system will inevitably bring great risks in the development of third-party payment. However, the existence of the above-mentioned kinds of risks will inevitably lead to hidden dangers in the development of the third-party payment industry, which will cause immediate harm to the vital interests of consumers and the development of enterprises and even the development of the whole economy and society of our country. Crisis our country economy market stability. To avoid and solve the risks of third-party payment industry, the most effective and compulsory means is to reform the relevant legal environment and directly change the current legal supervision system of the imperfect third-party payment platform from the legal level. To maintain the stable development of our country's economy and society. With the rapid development of third-party payment industry, the legislature of our country has realized the importance of legal supervision and issued some basic laws to supervise the third-party payment industry. However, the legal system of the domestic third-party payment platform, which started relatively late, has great imperfections compared with the developed countries. This article aims at the United States, the European Union, Japan and other countries and regions that have perfect supervision of third-party payment industry, study its excellent legal supervision experience, sum up the deficiencies of China's third-party payment industry in all aspects. The pertinence proposes the solution countermeasure, develops our country the third party payment industry better.
