【摘要】：電子合同的提出,打破了傳統(tǒng)理念,合同生效的方式、時間和地點與傳統(tǒng)合同存在很大的差異。電子合同作為電子文檔有著非常顯著的優(yōu)勢:電子合同可以在任何時間、任何地點簽署;查詢、存儲合同也帶來極大便捷性。通過詳細的研究《中華人民共和國合同法》、《中華人民共和國電子簽名法》以及《電子合同在線訂立流程規(guī)范》等法律法規(guī),并結(jié)合電子商務平臺交易中的安全需求,分析了PKI/CA技術如何保證電子合同簽署方身份的真實性,并通過使用電子簽名技術確保電子合同的完整性、真實性和不可抵賴性,將電子合同系統(tǒng)日志記錄和相關憑證有效的存儲及取證,從而解決電子合同抵賴以及法律糾紛問題。本文首先詳細地研究了電子合同系統(tǒng)的設計背景和意義,并充分的研究了國內(nèi)外的研究現(xiàn)狀,對信息安全領域的法律法規(guī)有比較深刻的解讀。然后重點介紹和分析了電子合同系統(tǒng)的設計與實現(xiàn)所要用到的關鍵技術,包括PKI/CA、電子簽章技術、可信時間戳技術以及人臉識別技術,為電子合同系統(tǒng)的實現(xiàn)提供技術和理論基礎。最后,充分調(diào)研用戶的需求,并作出需求分析,提出電子合同系統(tǒng)的概要和詳細設計方案,主要包括使用的軟件架構(gòu)、系統(tǒng)功能設計、數(shù)據(jù)庫設計、詳細接口設計與實現(xiàn)等。在上述系統(tǒng)總體設計的基礎上,本平臺基于天威誠信完善的CA證書體系、可信時間戳服務等信息安全基礎設施完成了一套有效的電子合同系統(tǒng)的實現(xiàn)并進行了測試。目前本平臺已經(jīng)進入試運行階段,企業(yè)和個人用戶可以登錄本平臺簽署電子合同,取得了良好的效果。
[Abstract]:The proposal of electronic contract breaks down the traditional idea, the way of the contract taking effect, the time and place of the contract are very different from the traditional contract. Electronic contracts as electronic documents have a very significant advantage: electronic contracts can be signed at any time, anywhere; query, storage contracts also bring great convenience. Through the detailed study of the laws and regulations such as the contract Law of the people's Republic of China, the Electronic signature Law of the people's Republic of China and the online procedure for the Establishment of Electronic contracts, and taking into account the security needs of e-commerce platform transactions, This paper analyzes how PKI/CA technology ensures the authenticity of the signer of electronic contract, and ensures the integrity, authenticity and non-repudiation of electronic contract by using electronic signature technology. The electronic contract system log records and related vouchers are effectively stored and collected to resolve the electronic contract repudiation and legal disputes. In this paper, the design background and significance of electronic contract system are studied in detail, and the current research situation at home and abroad is fully studied, and the laws and regulations in the field of information security are interpreted deeply. Then the key technologies used in the design and implementation of electronic contract system are introduced and analyzed, including PKI / CA, electronic signature technology, trusted timestamp technology and face recognition technology. It provides technical and theoretical basis for the realization of electronic contract system. Finally, the author makes a thorough investigation and analysis of the users' needs, and puts forward the outline and detailed design scheme of the electronic contract system, including the software architecture, the system function design, the database design, the detailed interface design and so on. On the basis of the overall design of the above system, this platform has completed an effective electronic contract system based on the CA certificate system, trusted timestamp service and other information security infrastructure. At present, the platform has entered the trial stage, enterprises and individual users can log on to the platform to sign electronic contracts, and achieved good results.
