【摘要】：消費糾紛作為生活中最常見的糾紛之一,隨著經(jīng)濟的不斷發(fā)展和網(wǎng)絡(luò)時代的來臨,糾紛形式也在不斷多樣化和復(fù)雜化。目前我國的消費糾紛主要通過兩種途徑來解決,包括非訴訟解決途徑和訴訟解決途徑,非訴訟解決途徑主要有三種方式,分別是和解、調(diào)解、仲裁。訴訟解決途徑的優(yōu)勢主要有公正性、權(quán)威性、國家強制性等,缺點主要是程序繁瑣、時間和物質(zhì)成本大,舉證困難等,由于消費糾紛本身具有爭議數(shù)額小、內(nèi)容簡單化,生活化等特點,這就決定了訴訟途徑解決方式不適合解決消費糾紛,實踐中,訴訟解決途徑成本高、程序復(fù)雜,讓消費者望而卻步;此外,消費者較于生產(chǎn)銷售者,屬于弱勢一方,本身的法律知識有限,維權(quán)意識不足,對于訴訟方式抱有恐懼態(tài)度,消費方式從當(dāng)初“一手交錢,一手交貨”的傳統(tǒng)模式,轉(zhuǎn)變?yōu)榻裉斓碾娮由虅?wù)消費模式,消費糾紛也隨著消費模式的轉(zhuǎn)變也而日益紛繁復(fù)雜。本文研究的目的明確,主要探究我國在線糾紛解決機制在消費領(lǐng)域的適用,通過對在線爭議解決機制的發(fā)展現(xiàn)狀、在線爭議解決機制的三種解決方式、在線爭議解決機制網(wǎng)絡(luò)平臺的應(yīng)用和管轄等內(nèi)容進(jìn)行探究,旨在為解決消費糾紛提供更加便捷、高效的途徑。
[Abstract]:As one of the most common disputes in life, with the continuous development of economy and the advent of the network era, the forms of disputes are becoming more and more diverse and complicated.At present, the consumption disputes in our country are mainly solved by two ways, including non-litigation settlement and litigation settlement, and non-litigation settlement, which are mainly composed of conciliation, mediation and arbitration.The advantages of litigation settlement are mainly fairness, authoritativeness, national compulsion, etc. The shortcomings are mainly cumbersome procedures, large time and material costs, difficulty in proving evidence, etc. Due to the small amount of disputes and simple contents of consumer disputes,In practice, the cost of litigation solutions is high, the procedures are complex, and consumers are deterred; in addition, consumers are more than producers and sellers.Belonging to the weak side, they have limited legal knowledge, lack of awareness of safeguarding their rights, and have a fearful attitude towards the way of litigation. The consumption mode has changed from the traditional mode of "hand in hand, hand in hand" to today's electronic commerce consumption mode.With the change of consumption pattern, consumer disputes are becoming more and more complicated.The purpose of this study is clear, mainly to explore the application of online dispute resolution mechanism in the field of consumption, through the development of online dispute resolution mechanism, online dispute resolution mechanism of three kinds of solutions,In order to provide a more convenient and efficient way to solve consumer disputes, the application and jurisdiction of online dispute settlement mechanism and network platform are explored.
