【摘要】：隨著互聯(lián)網(wǎng)技術(shù)的迅速發(fā)展,網(wǎng)絡(luò)購(gòu)物也越來(lái)越頻繁。作為當(dāng)今社會(huì)非傳統(tǒng)交易方式中最普遍的交易方式,網(wǎng)絡(luò)購(gòu)物方便了生活,但網(wǎng)絡(luò)購(gòu)物糾紛的數(shù)量也在不斷上漲,消費(fèi)者權(quán)益也面臨更嚴(yán)峻的挑戰(zhàn)。從發(fā)達(dá)國(guó)家和地區(qū)的法律規(guī)定以及國(guó)際條約來(lái)看,他們?cè)诤茉缰熬蛯?duì)直銷(xiāo)領(lǐng)域、上門(mén)銷(xiāo)售、遠(yuǎn)程交易、電子商務(wù)、郵購(gòu)買(mǎi)賣(mài)等交易模式中的消費(fèi)者賦予后悔權(quán)或者規(guī)定相應(yīng)的冷卻期,從而更好地保護(hù)了消費(fèi)者的權(quán)益。我國(guó)新修訂的《消費(fèi)者權(quán)益保護(hù)法》第二十五條有關(guān)于“七天無(wú)理由退貨”的規(guī)定實(shí)際上是在我國(guó)確立了消費(fèi)者后悔權(quán)制度,但是法律條文僅做出了簡(jiǎn)單的規(guī)定,對(duì)于后悔權(quán)適用的范圍、條件以及消費(fèi)者行使后悔權(quán)的限制等方面的規(guī)定尚不完善,該制度的實(shí)施還應(yīng)配以具體的實(shí)施細(xì)則,以及相應(yīng)的監(jiān)督措施。本文在明確后悔權(quán)概念與性質(zhì)的前提下,通過(guò)分析我國(guó)關(guān)于消費(fèi)者后悔權(quán)的立法現(xiàn)狀,為完善我國(guó)消費(fèi)者后悔權(quán)制度提供了思路上的借鑒,并結(jié)合現(xiàn)實(shí)消費(fèi)案例揭示的問(wèn)題,就我國(guó)消費(fèi)者后悔權(quán)實(shí)施細(xì)則、防止權(quán)力濫用的措施以及實(shí)施的保障機(jī)制等方面提出了完善我國(guó)消費(fèi)者后悔權(quán)制度的建議。
[Abstract]:With the rapid development of Internet technology, online shopping is becoming more and more frequent.As the most common transaction mode in today's society, online shopping facilitates life, but the number of online shopping disputes is also rising, consumer rights and interests are also facing more severe challenges.According to the laws and regulations of developed countries and regions as well as international treaties, they have long been involved in direct sales, home sales, remote trading, electronic commerce,In the mode of mail-order trading, consumers have the right of regret or the corresponding cooling-off period, thus protecting the rights and interests of consumers better.Article 25 of the newly revised Law on Protection of Consumer Rights and interests has the provision of "seven days without reason to return goods". In fact, the system of consumers' right of regret has been established in our country, but the provisions of the law have only made a simple provision.The scope and conditions of the application of the right of regret, as well as the restriction of the consumer's exercise of the right of regret, are not perfect, and the implementation of the system should be accompanied by specific rules and regulations, as well as the corresponding supervision measures.On the premise of defining the concept and nature of the right of regret, this paper analyzes the current situation of legislation on the right of consumer regret in our country, which provides a reference for perfecting the system of the right of regret of consumers in our country, and combines with the problems revealed by the real consumption cases.In this paper, the author puts forward some suggestions on how to perfect the system of consumer's right of regret in our country from the aspects of implementing detailed rules of consumer's right of regret, measures to prevent abuse of power and safeguard mechanism.
