【摘要】：電子商務是近年來出現(xiàn)的新型經(jīng)濟活動,由于目前針對電子商務專門的法律法規(guī)還未完善、政府對電子商務進行監(jiān)管的手段不夠等原因,當前電子商務中出現(xiàn)了很多違法活動,市場競爭混亂,消費者權益保障困難。這些問題極大制約了電子商務的發(fā)展,擾亂電子商務的經(jīng)營秩序。政府相關部門必須擔負起相關責任,重建有序競爭的電子商務市場秩序,對電子商務領域法律空白進行補充,加強監(jiān)管,讓電子商務市場的發(fā)展在正確軌道上前行。本文以福州市為例,應用市場失靈理論、政府干預理論、政府公共治理理論,綜合采用文獻分析法、比較分析法、調(diào)研法研究目前福州市電子商務發(fā)展現(xiàn)狀,通過問卷調(diào)查及訪談獲得第一手資料。研究發(fā)現(xiàn),當前福州市電子商務的政府監(jiān)管存在現(xiàn)有法律法規(guī)無法適應電子商務蓬勃發(fā)展的現(xiàn)狀,當前的電子信息數(shù)據(jù)庫也難以滿足對電子商務經(jīng)營主體進行征信監(jiān)管,同時對于監(jiān)管人員的培訓也顯得滯后于監(jiān)管需求等問題。因此為了對福州市當前電子商務進行有效監(jiān)管,應當從完善法律法規(guī),加強地區(qū)交流、培養(yǎng)復合型人才、完善征信體系、創(chuàng)新管理方法等多方面著手。借鑒西方發(fā)達國家以及我國政府監(jiān)管較成功城市的管理經(jīng)驗,通過對國內(nèi)電子商務市場的功能分析,對于政府監(jiān)管首先需要盡快確定電子商務的法律合法地位,對其從立法層面進行改善,提高市場準入標準,實施廣告營銷監(jiān)督,保護消費者權益,同時應當改善傳統(tǒng)監(jiān)管方式以適應新的監(jiān)管需求。本研究通過對福州市本地電子商務市場監(jiān)管探討,旨在提出建議,幫助福州市政府改善服務措施和監(jiān)管方式,促進福州電子商務市場的健康發(fā)展。
[Abstract]:E-commerce is a new type of economic activity that has appeared in recent years. Because the special laws and regulations for E-commerce are not perfect at present and the means of government supervision on E-commerce are not enough, there are many illegal activities in E-commerce at present.Market competition is chaotic, consumer rights and interests protection is difficult.These problems greatly restrict the development of e-commerce and disturb the business order of e-commerce.The relevant government departments must shoulder the relevant responsibilities, rebuild the order of the orderly competitive e-commerce market, supplement the legal blank in the field of electronic commerce, strengthen the supervision, and let the development of the electronic commerce market move forward on the right track.This paper takes Fuzhou as an example, applies the theory of market failure, the theory of government intervention, the theory of government public governance, synthetically adopts the literature analysis method, the comparative analysis method, the investigation method to study the present situation of the development of electronic commerce in Fuzhou.First-hand data were obtained by questionnaire and interview.The study found that the current government supervision of electronic commerce in Fuzhou has existing laws and regulations that can not adapt to the booming development of electronic commerce, and the current electronic information database is also difficult to meet the requirements of credit investigation and supervision of the main business entities of electronic commerce.At the same time, the training of supervisors also lags behind the regulatory needs and other issues.Therefore, in order to effectively supervise the current electronic commerce in Fuzhou, we should start from perfecting laws and regulations, strengthening regional exchanges, cultivating compound talents, perfecting credit information system and innovating management methods and so on.Based on the experience of the western developed countries and the successful cities in our country, through the analysis of the function of the domestic electronic commerce market, the legal status of the electronic commerce should be determined as soon as possible for the government supervision.At the same time, we should improve the traditional way of supervision to meet the new regulatory needs by improving the legislation, improving the standard of market access, implementing the supervision of advertising marketing, and protecting the rights and interests of consumers.The purpose of this study is to put forward some suggestions to improve the service measures and supervision methods of Fuzhou Municipal Government and to promote the healthy development of Fuzhou E-commerce market.
