“微商”模式下消費(fèi)者權(quán)益保護(hù)法律問(wèn)題研究

【摘要】:近年來(lái),由于智能手機(jī)的普及和移動(dòng)社交軟件用戶(hù)數(shù)量的急劇增加,越來(lái)越多的人開(kāi)始關(guān)注社交平臺(tái)巨大的商業(yè)價(jià)值。隨即產(chǎn)生出一種依賴(lài)于移動(dòng)社交軟件的新型電子商務(wù),那就是微商。由于入門(mén)容易,操作簡(jiǎn)單,工作靈活自由,微商實(shí)現(xiàn)了爆發(fā)式地發(fā)展。然而,由于沒(méi)有明確的法律規(guī)制也缺乏類(lèi)似于傳統(tǒng)網(wǎng)絡(luò)購(gòu)物的監(jiān)管措施,加之經(jīng)營(yíng)者誠(chéng)信意識(shí)淡薄導(dǎo)致微商的發(fā)展呈現(xiàn)出暴力刷屏、過(guò)度宣傳、假貨泛濫等亂象。消費(fèi)者的正當(dāng)權(quán)益遭到侵害且維權(quán)艱難日益影響著整個(gè)行業(yè)的健康發(fā)展。因而,微商模式下如何保護(hù)消費(fèi)者合法權(quán)益是橫亙?cè)谖覀兠媲暗囊粋(gè)亟待解決的問(wèn)題。本文除引言和結(jié)語(yǔ)外,正文共三個(gè)部分。第一部分提出問(wèn)題。鑒于微商是一種新型的購(gòu)物模式,筆者首先對(duì)微商進(jìn)行了界定,在此基礎(chǔ)上,對(duì)微商購(gòu)物與傳統(tǒng)購(gòu)物和網(wǎng)絡(luò)購(gòu)物進(jìn)行了對(duì)比。其次,指出微商購(gòu)物中消費(fèi)者權(quán)益保護(hù)面臨如下問(wèn)題:微商侵權(quán)具有隱蔽性、微商模式下消費(fèi)者求償權(quán)難以實(shí)現(xiàn)、微商模式下消費(fèi)者維權(quán)成本高。第二部分是分析問(wèn)題。對(duì)微商購(gòu)物中消費(fèi)者權(quán)益被侵犯的原因進(jìn)行了分析。首先,是立法上的原因。包括:對(duì)微商依賴(lài)的社交平臺(tái)的責(zé)任沒(méi)有規(guī)定;公益訴訟制度存在缺陷。其次,是工商監(jiān)管執(zhí)法的困境。包括:缺乏微商市場(chǎng)準(zhǔn)入制度;沒(méi)有針對(duì)微商的行之有效的監(jiān)管措施。第三,社交平臺(tái)缺乏對(duì)微商的監(jiān)管。包括:沒(méi)有實(shí)名認(rèn)證和擔(dān)保金,微商侵權(quán)代價(jià)極低;微商交易直接轉(zhuǎn)賬,財(cái)產(chǎn)安全難以保障;沒(méi)有信用評(píng)價(jià)導(dǎo)致消費(fèi)者無(wú)法對(duì)商家形成壓力。第三部分解決問(wèn)題。提出了微商模式下保護(hù)消費(fèi)者權(quán)益的建議。針對(duì)目前我國(guó)微商侵權(quán)的特點(diǎn)和原因,筆者認(rèn)為:首先,應(yīng)當(dāng)完善相關(guān)法律法規(guī)。包括:應(yīng)當(dāng)明確社交平臺(tái)的責(zé)任、完善公益訴訟制度。其次,構(gòu)建基于微信公眾號(hào)的工商監(jiān)管機(jī)制。包括:建立微商分類(lèi)電子準(zhǔn)入制度、建立針對(duì)微商的移動(dòng)在線糾紛解決機(jī)制。第三,落實(shí)社交平臺(tái)的監(jiān)管責(zé)任。包括:實(shí)行微商實(shí)名認(rèn)證、建立社交平臺(tái)上第三方支付制度、信用評(píng)價(jià)和黑名單制度、社交平臺(tái)先行賠付制度。
[Abstract]:In recent years, with the popularity of smartphones and the rapid increase in the number of mobile social software users, more and more people begin to pay attention to the enormous commercial value of social platforms. That is derivative quotient. Because of easy entry, simple operation, flexible and free work, the derivative has achieved explosive development. However, there is no clear legal regulation and lack of regulatory measures similar to traditional online shopping. In addition, the weak sense of good faith of the operators leads to violence, excessive propaganda, overspread of fake goods and other chaotic phenomena in the development of micromerchants. The legitimate rights and interests of consumers are infringed upon and the difficulty of protecting their rights and interests increasingly affects the healthy development of the whole industry. How to protect the legitimate rights and interests of consumers in the mode of derivative quotient is an urgent problem in front of us. In addition to the introduction and conclusion, there are three parts in the text. The first part puts forward the question. In view of the fact that the derivative is a new type of shopping mode, On the basis of this, the author compares the derivative shopping with traditional shopping and online shopping. Secondly, the author points out that the protection of consumers' rights and interests in the derivative shopping is faced with the following problems: the tort of the derivative is hidden. It is difficult to realize the consumer's claim right under the derivative mode, and the consumer's rights protection cost is high under the derivative mode. The second part is the analysis of the reason why the consumer's rights and interests are infringed in the derivative shopping. First of all, the author analyzes the reason why the consumer's rights and interests are infringed. It is the reason of legislation, including: the responsibility of the social platform relied on by the derivative is not stipulated; there are defects in the public interest litigation system; secondly, the dilemma of the industrial and commercial supervision and enforcement, including the lack of the market access system of the derivative; Third, the social platform lacks the supervision of the derivative, including: no real name certification and guarantee, the cost of infringement is very low, the derivative transactions transfer directly, the property security is difficult to guarantee; In the third part, the author puts forward some suggestions to protect the rights and interests of consumers under the model of derivative quotient. In view of the characteristics and reasons of tort of derivative business in our country, the author thinks: first of all, We should perfect the relevant laws and regulations, including: the responsibility of social platform should be clarified, and the public interest litigation system should be improved. Secondly, we should build a supervision mechanism for industry and commerce based on WeChat Official account. Establish mobile online dispute resolution mechanism for micro merchants. Third, implement the regulatory responsibility of social platform. Including: implementation of the derivative real name certification, the establishment of social platform third-party payment system, credit evaluation and blacklist system, Social platform advance payment system.
