【摘要】：正通過(guò)法治手段實(shí)現(xiàn)對(duì)網(wǎng)絡(luò)社會(huì)的有效治理,迅速推進(jìn)和加強(qiáng)網(wǎng)絡(luò)立法工作,是當(dāng)前落實(shí)依法治國(guó)方略的重要任務(wù)。就互聯(lián)網(wǎng)立法而言,我國(guó)應(yīng)當(dāng)采取專門立法的模式,不宜制定一部大而全的"互聯(lián)網(wǎng)管理法",具體理由在于:第一,互聯(lián)網(wǎng)技術(shù)和應(yīng)用的涉及范圍過(guò)于廣泛,很難抽象出一套普遍適用的治理原則和行為規(guī)范。第二,互聯(lián)網(wǎng)本質(zhì)上是一種信息技術(shù)手段和社會(huì)公共資源。第三,統(tǒng)一立法可能影響法律制度的實(shí)效,造成立法資源的浪費(fèi)和法
[Abstract]:It is an important task to implement the strategy of governing the country according to law to realize the effective governance of the network society by means of the rule of law, and to rapidly promote and strengthen the network legislation. As far as Internet legislation is concerned, our country should adopt the mode of special legislation. It is not appropriate to enact a large and comprehensive Internet Management Act, for the following reasons: first, the scope of Internet technology and applications is too broad to abstract a set of universally applicable governance principles and codes of conduct. The Internet is essentially a means of information technology and social public resources. Third, uniform legislation may affect the effectiveness of the legal system, resulting in the waste of legislative resources and laws.
