【摘要】：中國保險(xiǎn)產(chǎn)業(yè)整體起步較晚,行業(yè)規(guī)制理論與實(shí)踐均不同程度地落后于歐美國家。西方發(fā)達(dá)國家的政府規(guī)制由"政府-市場"型框架向"政府-市場-社會(huì)"型框架轉(zhuǎn)變,規(guī)制方式日趨豐富而多元。西方國家保險(xiǎn)業(yè)規(guī)制的有益經(jīng)驗(yàn)主要體現(xiàn)在構(gòu)建系統(tǒng)的金融法律制度,全方位、多層次的監(jiān)管體系,關(guān)注信息化技術(shù)進(jìn)展,嚴(yán)格規(guī)范保險(xiǎn)代理人行為,實(shí)施成本收益分析以及完善保險(xiǎn)混業(yè)經(jīng)營監(jiān)管規(guī)范等方面。以發(fā)展、揚(yáng)棄的觀點(diǎn)對待西方國家規(guī)制經(jīng)驗(yàn),重點(diǎn)吸收其經(jīng)驗(yàn)中的合理成分與純技術(shù)分析,構(gòu)建基于中國國情的政府規(guī)制理論體系。
[Abstract]:China's insurance industry as a whole started late, and the theory and practice of industry regulation lagged behind the European and American countries to some extent. The government regulation in western developed countries has changed from "government-market" framework to "government-market-society" framework. The beneficial experience of insurance regulation in western countries is mainly reflected in the construction of a systematic financial legal system, a comprehensive and multi-level regulatory system, a focus on the development of information technology, and strict regulation of insurance agent behavior. Carry out cost-benefit analysis and improve the regulation of insurance mixed operation and other aspects. From the point of view of development and sublation, this paper deals with the regulatory experience of western countries, and focuses on absorbing the reasonable components and pure technical analysis of their experiences, and constructs a theoretical system of government regulation based on the national conditions of China.
