【摘要】：我國《循環(huán)經(jīng)濟促進法》的立法邏輯錯位,從對其具體法律條文的梳理可以發(fā)現(xiàn),該法資源、廢物、產(chǎn)業(yè)推動的規(guī)范并存,造成法律調(diào)整對象不明確,難以有效實施。西方代表性國家的"循環(huán)經(jīng)濟"立法均選擇了以資源高效利用為核心的管制立法路徑。我國《循環(huán)經(jīng)濟促進法》的修訂存在產(chǎn)業(yè)促進和資源高效利用兩條立法路徑的選擇,以產(chǎn)業(yè)促進為立法邏輯構建循環(huán)經(jīng)濟產(chǎn)業(yè)鏈存在現(xiàn)實困難;循環(huán)經(jīng)濟相關產(chǎn)業(yè)調(diào)整更適合政策工具而非法律手段,立法回歸到以資源節(jié)約與綜合利用的管制路徑將是修改的可能方向。
[Abstract]:The legislation logic of the Circular economy Promotion Law in our country is wrong. From the combing of its specific legal provisions, it can be found that the norms of resources, wastes and industrial promotion of this law coexist, resulting in the unclear object of legal adjustment and the difficulty of effective implementation. The "circular economy" legislation in the representative countries of the West has chosen the legislative path of regulation with the efficient utilization of resources as the core. There are two legislative paths of industry promotion and efficient utilization of resources in the revision of circular economy promotion law in our country. It is difficult to construct circular economy industry chain with industry promotion as legislation logic. The adjustment of circular economy related industries is more suitable for the policy tools than the legal means, and the legislative return to the regulatory path of resource saving and comprehensive utilization will be the possible direction of revision.
