保定市市場監(jiān)督管理改革的問題研究

【摘要】:隨著市場經(jīng)濟在我國社會經(jīng)濟發(fā)展中重要性的體現(xiàn),在利益的驅(qū)動下,市場經(jīng)營中出現(xiàn)許多問題,這時政府就要體現(xiàn)監(jiān)管能力,來保障消費者的利益。目前保定市市場監(jiān)督管理體質(zhì)正處于改革摸索期間,以前的工商行政管理局、質(zhì)量技術(shù)監(jiān)督局、食品藥品監(jiān)督局三大市場監(jiān)督管理部門存在著權(quán)責(zé)不清、機構(gòu)重疊、效率低下等問題,重新對市場監(jiān)督管理部門進行設(shè)置,以厲行法制、加強監(jiān)管和提供服務(wù),為社會經(jīng)濟發(fā)展創(chuàng)造良好的環(huán)境。目前,全國不少省、直轄市的縣、區(qū)按中央要求,采取"二合一""三合一" "四合一"的新模式,成立綜合性的市場監(jiān)督管理主體。在精簡機構(gòu)的背景下,這種綜合設(shè)置目前還只能是一種探索,效果需要時間來檢驗。盡管一些地方新的綜合性市場監(jiān)督管理主體在市場監(jiān)管實踐中起到了積極作用,但在給企業(yè)帶來便利,在為政府減負的同時,一些問題也在實際的運行中逐步顯現(xiàn)。目前保定市各縣區(qū)市場監(jiān)督管理部門改革設(shè)置有以下兩種方式:一是工商行政管理局、質(zhì)量技術(shù)監(jiān)督局、食品藥品監(jiān)督局三大部門合為一個市場監(jiān)督管理局,將以前工商行政管理局、質(zhì)量技術(shù)監(jiān)督局、食品藥品監(jiān)督局的權(quán)責(zé)融合到一起,由新成立的市場監(jiān)督管理局統(tǒng)一負責(zé);二是工商行政管理局、食品藥品監(jiān)督局兩個部門合并,成立市場監(jiān)督管理局,質(zhì)量技術(shù)監(jiān)督局獨立,質(zhì)量技術(shù)監(jiān)督局以前負責(zé)的生產(chǎn)領(lǐng)域食品安全職能劃歸到市場監(jiān)督管理局。本文就這兩種部門設(shè)置方式,對其中的市場監(jiān)督管理工作所存在的問題進行分析研究,根據(jù)保定市實際的市場監(jiān)督管理中存在的問題進行原因查找,對市場監(jiān)督管理部門的責(zé)任劃分進行分析。一項制度的改革是個漫長、曲折的過程,本文還將如何加強市場監(jiān)督管理提出政策建議,并分析今后市場監(jiān)督管理改革可能的方向。
[Abstract]:With the importance of market economy in the social and economic development of our country, driven by interests, there are many problems in the market operation. At this time, the government should embody the ability of supervision to protect the interests of consumers. At present, Baoding City's market supervision and management body is in the period of reform and groping. The former three major market supervision and management departments of the Administration of Industry and Commerce, the Bureau of quality and Technology Supervision, and the Bureau of Food and Drug Supervision have unclear powers and responsibilities and overlapping institutions. In order to enforce the legal system, strengthen the supervision and service, and create a good environment for the social and economic development, the market supervision and management departments should be set up again. At present, many counties and districts of provinces and municipalities directly under the Central Government have adopted a new model of "two in one", "three in one" and "four in one" in accordance with the requirements of the central authorities, and have established a comprehensive market supervision and management body. In the context of streamlining, this integrated setting can only be a kind of exploration, the effect needs time to test. Although the new comprehensive market supervision and management subject in some places has played a positive role in the practice of market supervision, it has brought convenience to enterprises, and at the same time, some problems have gradually appeared in the actual operation while reducing the burden on the government. At present, there are two ways to reform the market supervision and administration departments in the counties, districts and districts of Baoding: first, the Administration for Industry and Commerce, the Bureau for quality and Technology Supervision, and the Food and Drug Administration are combined into one market supervision administration. The powers and responsibilities of the former Administration for Industry and Commerce, the Bureau of quality and Technology Supervision, and the Bureau of Food and Drug Administration shall be merged together, and the newly established Administration of Market Supervision shall be unified in charge; Second, the two departments of the Administration for Industry and Commerce and the Food and Drug Administration merged and established the Market Supervision Administration. The quality and Technology Supervision Bureau was independent, and the functions of food safety in the production field previously taken up by the quality and Technology Supervision Bureau were assigned to the Market Supervision Administration. In this paper, the problems in the market supervision and management are analyzed and studied, and the reasons for the problems in the market supervision and management in Baoding City are found out according to the actual market supervision and management of Baoding. Analyze the responsibility division of market supervision and management department. The reform of a system is a long and tortuous process. This paper also puts forward policy suggestions on how to strengthen market supervision and management, and analyzes the possible direction of the reform of market supervision and management in the future.
