【摘要】：在城鎮(zhèn)化的城市空間擴(kuò)張過程中,街道辦事處轄區(qū)內(nèi)通常包含一些村莊(即城中村)。受城鄉(xiāng)二元管理體制制約或由于人口轉(zhuǎn)居或集體資產(chǎn)處置滯后等原因,部分城中村無法納入屬地街道辦事處,而依舊由原屬鄉(xiāng)鎮(zhèn)管理,由此稱之為"非屬地城中村"。非屬地城中村存在管理交叉、職責(zé)不清的問題,利益矛盾集中,不僅違背行政區(qū)劃法的屬地化管理原則,而且對(duì)城鄉(xiāng)統(tǒng)籌發(fā)展構(gòu)成制約。通過對(duì)北京市155個(gè)非屬地城中村和相關(guān)部門、街道、鄉(xiāng)鎮(zhèn)的實(shí)地調(diào)查,對(duì)非屬地城中村的問題、特征和形成原因進(jìn)行了剖析;根據(jù)非屬地城中村行政管理差異化因素的分析,將北京市的非屬地城中村分為飛地村、難點(diǎn)村、滯后村、完成村四個(gè)類型;對(duì)屬地管理和非屬地管理模式下的城中村進(jìn)行對(duì)比分析�；谘芯�,提出城中村行政管理體制改革的關(guān)鍵在于明確屬地街道的主體責(zé)任及其在行政管理和社會(huì)服務(wù)兩個(gè)方面的職能,同時(shí),對(duì)各類型非屬地城中村的改革措施、時(shí)序和路徑提出了建議。
[Abstract]:In the urbanization of urban space expansion, the subdistrict office area usually contains some villages (I. e., villages in the city). Restricted by the dual management system of urban and rural areas or because of the population transfer or collective asset disposal lag, some villages in the city can not be brought into the subdistrict office, but are still managed by the original township, so it is called "the village in the city of non-dependent territory". The problems of overlapping management, unclear responsibilities and concentrated interests not only violate the principle of localization management of administrative division law, but also restrict the overall development of urban and rural areas. Based on the field investigation of 155 non-dependent urban villages and related departments, streets and towns in Beijing, this paper analyzes the problems, characteristics and formation reasons of non-dependent urban villages. This paper divides the urban villages of Beijing into enclave villages, difficult villages, laggards villages and complete villages, and makes a comparative analysis of the city-in-city villages under the pattern of territorial management and non-dependency management. Based on the research, the paper points out that the key to the reform of the administrative system of the villages in cities lies in clarifying the main responsibility of the subdistrict and its functions in the administration and social service, and at the same time, the reform measures for the villages in the cities of various types of non-dependent territories. The timing and path are suggested.
