我國(guó)保健食品監(jiān)管問(wèn)題研究

【摘要】:改革開(kāi)放以來(lái),人民群眾的生活水平不斷提高,在解決了溫飽問(wèn)題后,公眾對(duì)于食品的要求從“吃得飽”轉(zhuǎn)變?yōu)椤俺缘媒】怠。保健食品產(chǎn)業(yè)在經(jīng)濟(jì)發(fā)展、生活改善和公眾需要的大環(huán)境下應(yīng)運(yùn)而生。我國(guó)保健食品脫胎于二十世紀(jì)八十年代的保健藥品,經(jīng)歷了幾次市場(chǎng)的起落,現(xiàn)在的保健食品產(chǎn)業(yè)已形成規(guī)模,呈現(xiàn)出穩(wěn)步增長(zhǎng)的態(tài)勢(shì)。然而,炙手可熱的保健食品市場(chǎng)也潛伏著不可忽視的危機(jī),存在著亟待解決的問(wèn)題。新修訂的《食品安全法》針對(duì)保健食品設(shè)置了專門(mén)章節(jié),對(duì)保健食品監(jiān)管作了重大調(diào)整,從產(chǎn)品管理、生產(chǎn)、經(jīng)營(yíng)、廣告管理等方面實(shí)行嚴(yán)格監(jiān)管,確立了保健食品原料目錄和功能目錄管理相結(jié)合、注冊(cè)與備案管理相結(jié)合的管理制度,掀開(kāi)了保健食品發(fā)展和監(jiān)管的新篇章。本文在梳理保健食品監(jiān)管問(wèn)題的相關(guān)研究后,通過(guò)對(duì)我國(guó)保健食品監(jiān)管的現(xiàn)狀進(jìn)行分析,認(rèn)為我國(guó)保健食品監(jiān)管目前存在政策法規(guī)不完善、標(biāo)準(zhǔn)體系不健全、淘汰機(jī)制不完善、技術(shù)檢測(cè)跟不上等主要問(wèn)題。針對(duì)這些問(wèn)題,指出了造成這些問(wèn)題的原因主要是監(jiān)管法規(guī)體系建設(shè)緩慢、標(biāo)準(zhǔn)體系建設(shè)面臨諸多困難、激勵(lì)機(jī)制建設(shè)缺乏有效手段、檢驗(yàn)檢測(cè)機(jī)構(gòu)建設(shè)能力不足等。本文在分析借鑒美國(guó)、日本和歐盟的保健食品監(jiān)管經(jīng)驗(yàn)的基礎(chǔ)上,提出了完善我國(guó)保健食品監(jiān)管的有效對(duì)策:著力理順監(jiān)管體制,嚴(yán)厲打擊違法行為、集中開(kāi)展專項(xiàng)整治、營(yíng)造社會(huì)共治格局,加快標(biāo)準(zhǔn)體系建設(shè),落實(shí)生產(chǎn)經(jīng)營(yíng)規(guī)范,發(fā)揮信用引導(dǎo)作用,同時(shí),提高科學(xué)監(jiān)管保障,如實(shí)施電子監(jiān)管模式、提高檢驗(yàn)檢測(cè)水平、加強(qiáng)科普知識(shí)宣教等。
[Abstract]:Since the reform and opening up, the people's living standard has been improved continuously. After solving the problem of food and clothing, the public's demand for food has changed from "eating enough" to "eating healthily". The health food industry emerges as the times require in the environment of economic development, improvement of life and public needs. Health food in China was born in the eighties of the 20th century health care drugs, experienced several market ups and downs, now the health food industry has formed a scale, showing a steady growth trend. However, the hot health food market also lurks in a crisis that can not be ignored, and there are problems to be solved. The newly revised Food Safety Law has set up a special section for health food, and has made major adjustments to the supervision of health food. It has strictly regulated the management of products, production, operation, advertising, and so on. The management system of the combination of health food raw material catalogue and function catalogue management, registration and record keeping management was established, which opened a new chapter in the development and supervision of health food. After combing the relevant research on the health food supervision, this paper analyzes the current situation of the health food supervision in China, and points out that there are imperfect policies and regulations, imperfect standard system, and imperfect elimination mechanism in the health food supervision in our country. Technical detection can not keep up with the main problems. In view of these problems, it is pointed out that the main causes of these problems are the slow construction of the regulatory system, the difficulties faced in the construction of the standard system, the lack of effective means in the construction of the incentive mechanism, and the insufficiency of the construction capacity of the inspection and inspection institutions. On the basis of analyzing the experiences of health food supervision in the United States, Japan and the European Union, this paper puts forward some effective countermeasures to improve the health food supervision in China: to rationalize the supervision system, to crack down on illegal activities, and to focus on special regulation. It is necessary to build a pattern of social co-governance, speed up the construction of standard system, implement production and management norms, give play to the role of credit guidance, and at the same time, improve the scientific supervision and security, such as the implementation of electronic supervision mode, the improvement of the level of inspection and inspection, and the strengthening of propaganda and education of popular science knowledge.
