我國PPP模式中公私利益沖突的協(xié)調(diào)問題研究

【摘要】:近年來我國基礎(chǔ)設(shè)施建設(shè)遭遇了瓶頸危機(jī),過去政府主導(dǎo)投資的發(fā)展模式受到極大挑戰(zhàn)。從2013年P(guān)PP模式開始正式進(jìn)入公眾視野,隨著PPP模式如火如荼的進(jìn)行,而與PPP相關(guān)的立法卻相對落后,使得作為模式主體的政府和社會資本的利益沖突日益顯著,影響了制度本身的優(yōu)勢揮發(fā),甚至危及PPP模式的順利推進(jìn),于是PPP模式中公私利益沖突的協(xié)調(diào)問題研究迫在眉睫。從目前看,我國現(xiàn)行的與PPP相關(guān)的法規(guī)政策多為部門規(guī)章或者地方性法規(guī),權(quán)威性不足,甚至部分文件相互矛盾,使得社會資本對PPP項(xiàng)目參與度不高,社會各界對制定《政府和社會資本合作法》呼聲很高。PPP模式是促使經(jīng)濟(jì)良性發(fā)展的工具,而公私雙方利益的合理分配又是關(guān)系整個模式順利推進(jìn)的重中之重。雙方利益沖突的協(xié)調(diào)問題關(guān)系到各自合法權(quán)益的保障,影響社會資本的投資熱情,有助于提升政府的職能效率,同時也是對我國現(xiàn)行法制提出的新要求。本文立足實(shí)踐,在對公私雙方利益沖突各種表象分析的基礎(chǔ)上,側(cè)重于從立法層面分析公私雙方利益沖突的原因,結(jié)合國內(nèi)外相關(guān)案例,進(jìn)而重點(diǎn)探討我國公私利益沖突的協(xié)調(diào)建議。筆者認(rèn)為在現(xiàn)行經(jīng)濟(jì)背景下PPP將繼續(xù)得到青睞,其中的公私利益沖突問題也日漸緊迫,雖然公私雙方的立足點(diǎn)不同,但是可以通過博弈達(dá)到(29)(10)211的雙贏效果。筆者認(rèn)為二者的沖突雖然頻繁發(fā)生,解決也實(shí)屬不易,但是鑒于PPP項(xiàng)目具有周期長、投資金額大、風(fēng)險不確定等特點(diǎn),二者發(fā)生矛盾在所難免。通過對雙方權(quán)、責(zé)、利的明確;對風(fēng)險承擔(dān)和利益共享機(jī)制的規(guī)范;政府角色的轉(zhuǎn)換等方面的努力,雙方的沖突可以控制在合理的范圍內(nèi)。筆者認(rèn)為在國家大力倡導(dǎo)PPP模式背景下,PPP項(xiàng)目和意圖參與PPP項(xiàng)目的投資方會越來越多,而國內(nèi)目前比較成功的PPP案例并不多見,很多即使在當(dāng)時看似成功的案例后期矛盾沖突不斷,所以筆者認(rèn)為現(xiàn)在最要緊的是協(xié)調(diào)好兩大利益主體的沖突問題,以成功范例引導(dǎo)PPP模式的順利推進(jìn)。
[Abstract]:In recent years, China's infrastructure construction has encountered a bottleneck crisis, the past government-led investment development model has been greatly challenged. The PPP model has been formally entered the public view since 2013. With the development of the PPP model in full swing, and the relative backward legislation related to PPP, the conflict of interest between the government and social capital, as the main body of the model, is becoming more and more obvious. It affects the volatilization of the system itself and even endangers the smooth advance of the PPP model, so the research on the coordination of the conflicts of public and private interests in the PPP model is urgent. From the current point of view, the current laws and regulations related to PPP in China are mostly departmental regulations or local laws and regulations, which are not authoritative enough, and even some documents contradict each other, which makes the participation of social capital in PPP projects not high. The PPP model is a tool to promote the benign development of the economy, and the rational distribution of the interests of both public and private parties is the most important part of the smooth promotion of the whole model. The coordination of the conflict of interests between the two sides is related to the protection of their legitimate rights and interests, and affects the investment enthusiasm of social capital, which helps to improve the efficiency of the government's functions, and is also a new requirement for the current legal system of our country. Based on practice and on the basis of analyzing various representations of conflicts of interest between public and private parties, this paper focuses on the analysis of the causes of conflicts of interest between public and private parties from the legislative level, combining with relevant cases at home and abroad. Then the author focuses on the suggestion of coordination of the conflict of public and private interests in our country. The author thinks that PPP will continue to be favored under the current economic background, in which the conflict of public and private interests is becoming more and more urgent. Although the standpoint of both public and private parties is different, the win-win effect can be achieved through the game. The author thinks that although the conflict between the two occurs frequently, it is not easy to resolve, but in view of the characteristics of PPP project with long period, large investment amount and uncertain risk, the contradiction between them is inevitable. The conflict between the two sides can be controlled within a reasonable range through the clarification of the rights, responsibilities and benefits of both sides, the regulation of the risk-bearing and benefit-sharing mechanism, and the transformation of the role of the government. The author believes that more and more investors will participate in the PPP project under the background of the national advocacy of the PPP model, but there are few successful PPP cases in China. Even at the late stage of the seemingly successful cases, the author thinks that the most important thing is to coordinate the conflict between the two main stakeholders, and to guide the PPP model to advance smoothly with successful examples.
