【摘要】：近年來,關(guān)于地方的食品安全監(jiān)管職能究竟是由單設(shè)的食藥監(jiān)部門承擔(dān),還是交由綜合的市場(chǎng)監(jiān)管部門,始終爭(zhēng)論不斷。原本選擇何種監(jiān)管方式應(yīng)遵循"合并職能相近、相似的部門"的大部制改革原則,但不論是中央還是地方的機(jī)構(gòu)改革方案和說明中,對(duì)何謂"職能相似"并未作出過解釋,導(dǎo)致監(jiān)管模式的爭(zhēng)論一定程度上轉(zhuǎn)變?yōu)椴块T間的博弈。要使?fàn)幷撝匦禄氐酱蟛恐聘母锏脑瓌t下進(jìn)行,必須對(duì)"職能相似"做出解釋。本文通過對(duì)"職能相似"標(biāo)準(zhǔn)的界定和運(yùn)用,認(rèn)為從監(jiān)管體制的角度,綜合的市場(chǎng)監(jiān)管部門更適宜在多部門監(jiān)管架構(gòu)和分級(jí)管理體制下組建,單設(shè)的食藥監(jiān)部門更適宜在少部門監(jiān)管架構(gòu)和垂直管理體制下組建;從監(jiān)管事項(xiàng)的角度,綜合的市場(chǎng)監(jiān)管部門更適宜在食品產(chǎn)業(yè)分散,違法種類多樣但事實(shí)并不復(fù)雜的地區(qū)運(yùn)行,單設(shè)的食藥監(jiān)部門則更適宜在食品產(chǎn)業(yè)集中,違法種類單一但事實(shí)復(fù)雜的地區(qū)運(yùn)行。
[Abstract]:In recent years, there has been a constant debate on whether the function of local food safety supervision should be undertaken by a single food and drug supervision department or by a comprehensive market supervision department. The principle of "merging similar departments with similar functions" should be followed by the principle of "merging similar functions and similar departments", but no explanation has been given to what is meant by "functional similarity" in the plan and explanation of the institutional reform of the central or local authorities. As a result, the debate over the regulatory model has to some extent changed into a game between departments. In order to bring the debate back to the principle of big-department reform, it is necessary to explain the "functional similarity". Based on the definition and application of the standard of "functional similarity", this paper holds that, from the perspective of regulatory system, the integrated market supervision department is more suitable to be set up under the multi-sector regulatory framework and hierarchical management system. Separate food and drug supervision departments are more suitable to be set up under the regulatory framework and vertical management system of fewer departments; from the perspective of regulatory matters, integrated market supervision departments are more suitable for dispersing in the food industry. There are many kinds of violations but the facts are not complicated to operate, the only food and drug supervision department is more suitable for the concentration of food industry, the single category of illegal but the facts are complex areas to operate.
