【摘要】：隨著我國(guó)專(zhuān)利制度的逐漸完善,地方政府在專(zhuān)利管理中發(fā)揮的重要性日益顯著。溫州作為曾經(jīng)的私營(yíng)企業(yè)蓬勃發(fā)展之城,隨著經(jīng)濟(jì)轉(zhuǎn)型升級(jí)趨勢(shì)的到來(lái),面臨著原來(lái)的私營(yíng)企業(yè)科技含量低下、轉(zhuǎn)型升級(jí)難等瓶頸,因此急需加強(qiáng)專(zhuān)利方面的改革和推動(dòng)。在全國(guó)現(xiàn)有的統(tǒng)一專(zhuān)利制度框架下,如何提高地方政府專(zhuān)利管理效率,制定適合市場(chǎng)發(fā)展和科學(xué)規(guī)律的專(zhuān)利地方管理策略對(duì)于溫州刻不容緩。本文以溫州市政府專(zhuān)利管理為研究對(duì)象,通過(guò)實(shí)地調(diào)查、案例分析、比較研究等方法,盡可能客觀全面地獲取本市及國(guó)內(nèi)相關(guān)城市的專(zhuān)利管理數(shù)據(jù)和信息加以分析,并運(yùn)用服務(wù)型政府理論和產(chǎn)權(quán)理論對(duì)溫州當(dāng)前專(zhuān)利管理中的具體做法、獲得的成效、存在的問(wèn)題和面臨的挑戰(zhàn)等方面進(jìn)行分析。針對(duì)溫州市專(zhuān)利管理目前存在的專(zhuān)業(yè)人員不足問(wèn)題,提出要在地方政府專(zhuān)利管理過(guò)程中引入第三方社會(huì)機(jī)構(gòu),加強(qiáng)對(duì)于專(zhuān)利技術(shù)專(zhuān)業(yè)性的支持;針對(duì)溫州市各區(qū)縣企業(yè)授權(quán)專(zhuān)利使用率不高等問(wèn)題,建議建立地方專(zhuān)利池,加強(qiáng)同區(qū)域企業(yè)之間的專(zhuān)利"互惠";針對(duì)本市缺乏專(zhuān)門(mén)的專(zhuān)利交易平臺(tái),提出加強(qiáng)互聯(lián)網(wǎng)+地方專(zhuān)利交易平臺(tái)建設(shè)等創(chuàng)新觀點(diǎn)。本文從溫州本地專(zhuān)利市場(chǎng)需求角度出發(fā),為政府相關(guān)公共政策提出意見(jiàn)和建議,以便政府在專(zhuān)利管理中發(fā)揮更有效的作用。
[Abstract]:With the improvement of patent system in China, the importance of local government in patent management is becoming more and more significant. Wenzhou, as a booming city of private enterprises, with the arrival of the trend of economic transformation and upgrading, is facing the bottleneck of the original private enterprises, such as low science and technology content, difficulty in transformation and upgrading, so it is urgent to strengthen the reform and promotion of patent. Under the framework of the current unified patent system in China, it is urgent for Wenzhou to improve the efficiency of local government patent management and to formulate a patent local management strategy suitable for market development and scientific law. This article takes Wenzhou municipal government patent management as the research object, through field investigation, case analysis, comparative study and so on, obtains the patent management data and information of this city and the domestic related cities as objectively and comprehensively as possible, and analyzes the patent management data and information of the city and related cities in China. Using the theory of service-oriented government and the theory of property right, this paper analyzes the concrete practices, achievements, problems and challenges in the patent administration of Wenzhou at present. In view of the shortage of professional personnel in patent management in Wenzhou City, it is proposed to introduce the third party social organization in the process of patent management of local government, and strengthen the support for the specialty of patent technology. In view of the problem of low patent utilization rate of enterprises in every district and county of Wenzhou, it is suggested that local patent pools should be set up to strengthen the "reciprocity" of patents between enterprises in the same region, and that there is no special patent trading platform in this city. Put forward to strengthen the Internet local patent trading platform construction and other innovative points of view. From the point of view of the demand of Wenzhou local patent market, this paper puts forward opinions and suggestions for the relevant public policies of the government, so that the government can play a more effective role in the patent administration.
