【摘要】：隨著我國建筑業(yè)的持續(xù)發(fā)展,建設(shè)項(xiàng)目的規(guī)模越來越大,不確定性程度越來越高。合同柔性作為應(yīng)對不確定性的有效手段,越來越受到研究學(xué)者們的關(guān)注。綜合現(xiàn)有文獻(xiàn)發(fā)現(xiàn),注入合同柔性的途徑有很多種,其中價格柔性是學(xué)者們普遍認(rèn)可的一種途徑。本文的研究對象為專業(yè)工程暫估價,是價格柔性的一種。專業(yè)工程暫估價的設(shè)置雖然解決了因標(biāo)準(zhǔn)不明確而導(dǎo)致招標(biāo)進(jìn)度的問題,但也易引起承包人機(jī)會主義行為的發(fā)生,且設(shè)置范圍越大,承包人產(chǎn)生機(jī)會主義行為的概率越大。究其原因在于合同柔性越大,承包人產(chǎn)生機(jī)會主義行為的概率會增大。研究表明,機(jī)會主義是信任存在的必要。信任程度越高,機(jī)會主義產(chǎn)生的損失越低。基于此,本文的研究內(nèi)容包括以下三部分。首先,本文通過演繹法推出專業(yè)工程暫估價是一種價格柔性,是注入合同柔性的一種途徑。價格柔性表現(xiàn)為初始的合同價格可能會增加或者減少、交易當(dāng)事人可能對價格進(jìn)行再談判或者再精確確定。專業(yè)工程暫估價符合價格柔性的特征。并從專業(yè)工程暫估價設(shè)置范圍和定價方式兩個方面討論了專業(yè)工程暫估價柔性程度大小,最后形成了專業(yè)工程暫估價柔性的分析圖。其次,本文分析了初始信任產(chǎn)生的階段,得出初始信任主要產(chǎn)生于招投標(biāo)階段的資格預(yù)審環(huán)節(jié)。并運(yùn)用文本分析法和文獻(xiàn)勾選法對資格預(yù)審指標(biāo)和初始信任的影響因素進(jìn)行了歸納和總結(jié),由此得出劃分初始信任等級的資格預(yù)審指標(biāo)。并通過文本分析法得出影響初始信任程度指標(biāo)的劃分標(biāo)準(zhǔn),最終形成不同初始信任等級對應(yīng)的資格預(yù)審指標(biāo)。最后,本文分析了專業(yè)工程暫估價柔性與初始信任匹配的必要性,并通過文獻(xiàn)綜述得出專業(yè)工程暫估價柔性應(yīng)與初始信任進(jìn)行正向匹配,并結(jié)合第四章和第五章對專業(yè)工程暫估價柔性程度的分析和初始信任程度的分析,最終形成專業(yè)工程暫估價柔性與初始信任的匹配結(jié)果。綜上,本文研究了專業(yè)工程暫估價柔性與初始信任兩者之間的匹配,致力于解決專業(yè)工程暫估價的設(shè)置所帶來的機(jī)會主義問題。本文基于合同柔性與初始信任的相關(guān)綜述,提出專業(yè)工程暫估價柔性與初始信任的匹配方案,為工程實(shí)踐專業(yè)工程暫估價的設(shè)置和承包人的選擇提供了借鑒。
[Abstract]:With the sustainable development of the construction industry in China, the scale of construction projects is becoming larger and larger, and the degree of uncertainty is becoming higher and higher. As an effective means to deal with uncertainty, contract flexibility has been paid more and more attention by researchers. According to the existing literature, there are many ways to inject contract flexibility, among which price flexibility is generally accepted by scholars. The research object of this paper is the temporary valuation of professional engineering, which is a kind of price flexibility. The setting of temporary evaluation of professional engineering solves the problem of bidding progress caused by unclear standard, but it also easily causes the opportunistic behavior of contractor, and the larger the scope of setting, the greater the probability of opportunistic behavior of contractor. The reason is that the greater the flexibility of the contract, the greater the probability of opportunistic behavior. Research shows that opportunism is necessary for the existence of trust. The higher the level of trust, the lower the loss from opportunism. Based on this, the research content of this paper includes the following three parts. Firstly, this paper deduces that the provisional valuation of professional engineering is a kind of price flexibility and a way to inject contract flexibility. The price flexibility is that the initial contract price may increase or decrease, and the parties to the transaction may renegotiate the price or determine the price accurately. The temporary valuation of professional engineering accords with the characteristics of price flexibility. The degree of flexibility of temporary evaluation of professional engineering is discussed from two aspects of setting range and pricing mode of temporary evaluation of professional engineering. Finally, an analytical diagram of temporary evaluation flexibility of professional engineering is formed. Secondly, this paper analyzes the stage of initial trust, and draws the conclusion that initial trust mainly comes from pre-qualification in bidding stage. The text analysis method and the literature tick method are used to summarize the prequalification index and the influencing factors of the initial trust, and the prequalification index to divide the initial trust grade is obtained. And through the text analysis method, we can get the classification standard that affects the initial trust degree index, and finally form the pre-qualification index corresponding to different initial trust level. Finally, this paper analyzes the necessity of matching professional engineering temporary evaluation flexibility with initial trust, and draws a conclusion that professional engineering temporary evaluation flexibility and initial trust should be positively matched through literature review. Combined with the analysis of the flexibility of temporary evaluation and the degree of initial trust of professional engineering in the fourth and fifth chapters, the matching result between the flexibility of temporary evaluation of professional engineering and the initial trust is finally formed. In summary, this paper studies the matching between the flexibility of temporary evaluation of professional engineering and the initial trust, and tries to solve the opportunistic problem caused by the setting of temporary evaluation of professional engineering. Based on the summary of the relationship between contract flexibility and initial trust, this paper puts forward a matching scheme of professional engineering temporary evaluation flexibility and initial trust, which provides a reference for the setting of temporary evaluation of professional engineering and the selection of contractors.
