【摘要】:宋代是中國古代社會發(fā)展的又一個高峰,其社會經濟各個方面都展示出迅速發(fā)展的勢頭。商業(yè)繁榮,市場經濟活躍,連鄉(xiāng)村地區(qū)也被納入商業(yè)圈。隨著商業(yè)的不斷發(fā)展,城市中坊市制逐漸渙散直至崩潰,使得城市呈現(xiàn)出更加開放的姿態(tài);同行業(yè)間形成了行會組織捍衛(wèi)共同的利益;海外貿易也發(fā)展到一個新高度。城市的規(guī)模擴大,數(shù)量增多,且經濟功能越發(fā)明顯,城市中人口也大幅增加;鄉(xiāng)村中土地流通速度加快,人身依附關系松弛,人從土地上解放出來,人口流動頻繁。人們的觀念隨著社會的發(fā)展也有所改變,傳統(tǒng)的義利觀受到挑戰(zhàn),社會上重財現(xiàn)象普遍而嚴重,土地房屋買賣成為常態(tài),許多士人官員甚至政府也從事商業(yè),與民爭利。法律對于私有財產的重視與保護也出現(xiàn)了前代未有的力度。宋代房屋買賣的價格從鄉(xiāng)村到城市呈現(xiàn)出較高的趨勢,且城市和地段的不同價格也不同。參與房屋買賣的雙方及中介必須按法律規(guī)定的程序進行買賣,并在法律規(guī)定的程序中扮演好自己的角色,履行好彼此的權利義務,才能在出現(xiàn)糾紛時受到法律的保護。家庭中繼承人可以通過析產獲得房屋產權。繼承人的范圍法律明確進行過規(guī)定,尤其是戶絕財產的繼承。然而由于房屋的重要性,即使是親人之間也會產生糾紛,這時就需要法律和家族的處理。房屋買賣價格的高昂和人口的流動等因素促使宋代房屋租賃行業(yè)發(fā)達。由于房租收入的可觀性,個人以及政府都參與房屋出租的行業(yè)中,且房租在政府收入中占有重要比例。房屋租賃雙方也必須依法行事,這樣在糾紛發(fā)生時權益便能得到保障。此外政府為保證社會穩(wěn)定,對于災民、宗室、官員、歸正人這些特殊人群的住房問題采取特殊措施加以解決。
[Abstract]:The Song Dynasty was another peak of social development in ancient China. All aspects of its social and economic development showed a momentum of rapid development. Business flourished, market economy was active, and even rural areas were brought into the business circle. With the continuous development of commerce, The city-state system gradually slackened and collapsed, making the city more open; guild organizations formed with the same industry to defend common interests; overseas trade also reached a new height. The size and number of cities expanded, and the number of cities increased. And the economic function became more and more obvious, and the population in the city also increased substantially; the circulation of land in the countryside was accelerated, the personal attachment was relaxed, the people were liberated from the land, and the population moved frequently. People's ideas changed with the development of society. The traditional view of righteousness and interest was challenged, and the phenomenon of heavy wealth in society was widespread and serious. Land and housing transactions became the norm, and many scholars and officials and even the government were engaged in business. The law paid more attention to private property than in previous generations. The price of houses sold and sold in the Song Dynasty showed a higher trend from the countryside to the city. And the prices of different cities and lots are different. The parties and intermediaries involved in the purchase and sale of houses must follow the procedures prescribed by law, and play their part in the procedures prescribed by law, and fulfill each other's rights and obligations. In order to be protected by law in the event of a dispute, the heirs in the family may acquire property rights in the house through property analysis. The scope of the heirs is clearly defined by law, especially in the case of inheritance of property from the household. However, because of the importance of the house, Even family members will have disputes, which need to be dealt with by the law and the family. The high price of housing and the mobility of the population contributed to the development of the housing rental industry in the Song Dynasty. Both individuals and governments are involved in the rental industry, and rents account for an important proportion of government revenue. Both parties must act in accordance with the law so that their rights and interests can be safeguarded in the event of disputes. In addition, the government is trying to ensure social stability. Special measures should be taken to solve the housing problems of victims, clans and officials.
