我國(guó)保障房分配制度的問題及對(duì)策研究

【摘要】:改革開放以來,我國(guó)住房建設(shè)逐漸趨于市場(chǎng)化,住房產(chǎn)業(yè)進(jìn)入了高速發(fā)展階段,城鎮(zhèn)居民的居住條件得到很大改善。然而,近幾年來,房?jī)r(jià)持續(xù)上漲,中低收入階層陷入了住房難的困境,妥善解決中低收入階層的住房難問題,關(guān)乎社會(huì)的和諧穩(wěn)定和我國(guó)的長(zhǎng)遠(yuǎn)發(fā)展。為妥善解決這一問題,我國(guó)啟動(dòng)了保障性住房安居工程的重點(diǎn)建設(shè)。因?yàn)檫@一政策的特殊性,公正合理有效的分配,是保障性住房達(dá)到預(yù)期社會(huì)效果的關(guān)鍵。雖然在分配制度上不斷趨于完善,但是,在實(shí)踐中仍存在分配不公的現(xiàn)象,比如部分主持分配者暗箱操作、申購者騙購騙租,導(dǎo)致部分保障房未落實(shí)到真正需要它的人手中,而且由于這些問題的根本性,很難在短時(shí)間之內(nèi)得到改善。在這樣的大背景下,若不能妥善解決保障房分配領(lǐng)域中存在的問題,必定會(huì)激化新的社會(huì)矛盾,如何妥善解決分配環(huán)節(jié)存在的一系列問題成為重中之重。本文從我國(guó)保障性住房安居工程的特殊性著手,以分配制度為主線,深入分析國(guó)內(nèi)外在住房保障中的研究成果,在理論分析的基礎(chǔ)上,著重研究經(jīng)濟(jì)適用房和公共租賃住房在分配中存在的問題,提出幾點(diǎn)合理的建議及對(duì)策。本文以從問題到對(duì)策的思路,在現(xiàn)有制度的基礎(chǔ)上,對(duì)我國(guó)保障性住房分配制度進(jìn)行了分析探討,全文分為五部分:第一部分,我國(guó)保障性住房的分配理論。理論基礎(chǔ)主要包括人權(quán)理論與公平分配理論,著重分析保障性住房的范圍界定及其特點(diǎn),在此基礎(chǔ)上探討經(jīng)濟(jì)適用房和公共租賃住房分配政策之內(nèi)涵、公平合理分配之意義。第二部分,我國(guó)保障性住房分配制度的現(xiàn)狀及存在的問題。本部分從分配現(xiàn)狀著手,對(duì)保障性住房分配的準(zhǔn)入、監(jiān)管和退出機(jī)制中存在的問題進(jìn)行概括分析,主要存在覆蓋范圍小,申請(qǐng)者騙購騙租,主持分配者暗箱操作等問題。第三部分,影響我國(guó)保障性住房公平分配的原因分析。本部分主要從立法層面、法律層面和政策層面來分析該領(lǐng)域出現(xiàn)問題的原因,對(duì)這些問題進(jìn)行研究分析,為后文完善保障性住房分配制度奠定基礎(chǔ)。第四部分,國(guó)外保障性住房分配制度的經(jīng)驗(yàn)及啟示。本部分主要是研究國(guó)外成熟的分配制度,研究他們?cè)谕晟票緡?guó)住房分配制度上的先進(jìn)經(jīng)驗(yàn),在此基礎(chǔ)上,結(jié)合我國(guó)實(shí)際國(guó)情,彌補(bǔ)我國(guó)在保障性住房分配制度上存在的缺陷。第五部分,我國(guó)保障性住房分配制度的完善。本部分主要針對(duì)前文的分析,在借鑒國(guó)內(nèi)外保障性住房分配領(lǐng)域先進(jìn)經(jīng)驗(yàn)的基礎(chǔ)上,結(jié)合我國(guó)分配領(lǐng)域中存在的亂象,提出幾點(diǎn)合理建議。力求在我國(guó)建立一套完善的保障性住房分配機(jī)制。
[Abstract]:Since the reform and opening up, housing construction in China has gradually become market-oriented, the housing industry has entered a stage of rapid development, the living conditions of urban residents have been greatly improved. However, in recent years, housing prices continue to rise. The middle and low income class is in the difficult position of housing. To solve the housing problem properly, it is related to the social harmony and stability and the long-term development of our country. In order to solve this problem properly. Our country has started the key construction of the secure housing project, because of the particularity of this policy, fair, reasonable and effective distribution. It is the key to achieve the expected social effects of affordable housing. Although the distribution system is constantly improving, but in practice, there are still unfair distribution phenomena, such as part of the distribution of the dark box operation. Because of the fundamental nature of these problems, it is difficult to improve in a short period of time. In such a big context, the requisitioners tricked into rent fraud, leading some indemnificatory apartment to fail to put it into the hands of those who really need it. If we cannot properly solve the problems existing in indemnificatory apartment's distribution field, we will certainly intensify new social contradictions. How to properly solve a series of problems existing in the distribution link has become the most important. This paper starts with the particularity of the security housing project in our country, taking the distribution system as the main line. Deeply analyze the domestic and foreign research results in housing security, on the basis of theoretical analysis, focus on comfortable housing and public rental housing in the distribution of problems. Put forward several reasonable suggestions and countermeasures. Based on the existing system, this paper analyzes and discusses the distribution system of our country's affordable housing, which is divided into five parts: the first part. The distribution theory of affordable housing in China. The theoretical basis mainly includes human rights theory and fair distribution theory, focusing on the definition of the scope of affordable housing and its characteristics. On this basis, this paper discusses the connotation of comfortable housing and the allocation policy of public rental housing, and the significance of fair and reasonable distribution. The second part. This part from the distribution status quo, the allocation of affordable housing in the access, supervision and exit mechanism of the existing problems are summarized and analyzed. There are some problems, such as small coverage, fraud and rent fraud by the applicant, and the operation of the distributor. The third part is the analysis of the reasons that affect the fair distribution of the indemnificatory housing in our country. This part is mainly from the legislative level. The legal level and the policy level to analyze the causes of the problems in this field, to carry out research and analysis of these issues, for the later completion of affordable housing allocation system laid the foundation. 4th part. This part is mainly to study the mature distribution system of foreign countries, to study their advanced experience in the improvement of their own housing distribution system, on the basis of this. Combined with the actual situation of our country, to make up for the shortcomings of our country in the distribution system of affordable housing. Part 5th, the improvement of our country's affordable housing distribution system. This part is mainly aimed at the previous analysis. On the basis of drawing lessons from the advanced experience in the field of affordable housing distribution at home and abroad, combined with the confusion in the field of distribution in our country, this paper puts forward some reasonable suggestions and tries to establish a set of perfect mechanism for the distribution of affordable housing in our country.
