【摘要】：隨著2013年《國(guó)務(wù)院機(jī)構(gòu)改革和職能轉(zhuǎn)變方案》的頒布,我國(guó)的商事登記制度改革全面執(zhí)行。市場(chǎng)的準(zhǔn)入條件被進(jìn)一步放寬,對(duì)應(yīng)的商事監(jiān)管發(fā)生了從原本的嚴(yán)格把控市場(chǎng)準(zhǔn)入到“寬進(jìn)嚴(yán)管”的轉(zhuǎn)變。在該過(guò)程中商事監(jiān)管的方法、方式都需要有對(duì)應(yīng)的調(diào)整來(lái)適應(yīng)新的變化。本文從商事登記制度改革前后的對(duì)比入手,分析了商事登記制度改革后,企業(yè)監(jiān)管的現(xiàn)狀,并對(duì)商事登記制度改革的成效進(jìn)行了分析,肯定了商事制度改革必要性的的同時(shí),也看到了企業(yè)監(jiān)管的不足之處。并采用調(diào)查問(wèn)卷的方式進(jìn)行了調(diào)查分析,采用Cronbach系數(shù)和KMO值校核了調(diào)查問(wèn)卷的信度和效度,并以貢獻(xiàn)度作為依據(jù)提取了影響企業(yè)監(jiān)管主要的影響因子,確立了新的商事登記制度下企業(yè)監(jiān)管所需要改進(jìn)的主要因素。最后從商事登記制度改革后的商事主體監(jiān)管方式、監(jiān)管環(huán)境以及監(jiān)管主體這三個(gè)方面提出了對(duì)應(yīng)的改進(jìn)措施和建議。提出在監(jiān)管方式上應(yīng)當(dāng)采用多樣化的監(jiān)管方式,對(duì)于定期檢查的時(shí)間尺度上應(yīng)當(dāng)根據(jù)商事主體的個(gè)體差別來(lái)擬定檢查周期,并且配合不定期的隨機(jī)抽查來(lái)實(shí)現(xiàn)對(duì)商事主體的檢查,在監(jiān)管制度上設(shè)計(jì)除名信用制度。在監(jiān)管主體上應(yīng)當(dāng)進(jìn)一步的多元化,將消費(fèi)者和商事主體納入到監(jiān)管的主體中,推動(dòng)建立完備的市場(chǎng)自律機(jī)制。在監(jiān)管環(huán)境方面,可以結(jié)合現(xiàn)有的技術(shù)力量建立征信平臺(tái),同時(shí)通過(guò)不斷完善相應(yīng)的法律法規(guī),來(lái)進(jìn)一步促進(jìn)商事監(jiān)管的完善。
[Abstract]:Along with the transformation program in 2013 < the institutional reform of the State Council and functions > promulgated, commercial registration system reform in our country. The full implementation of market access conditions to be further relaxed, the corresponding commercial regulation changed from the original strictly control market access to "wide into the strict control of the method. The commercial regulation in this process. The way needs to have a corresponding adjustment to adapt to the new changes. This article from the commercial registration system reform before and after contrast with the analysis of the commercial registration system reform, the present situation of enterprise supervision, and the commercial registration system reform are analyzed, and the necessity of certain commercial system reform, also saw a lack of in the enterprise supervision. And using the method of questionnaire investigation and analysis of the Cronbach coefficient and KMO value to check the reliability and validity of the survey questionnaire and the contribution as the basis The extraction effect of corporate governance factors, established a new commercial registration system under the supervision of enterprises need improvement. Finally, the main factors from the commercial registration system of commercial subject of regulatory reform, the three aspects of the regulatory environment and regulatory body to put forward the improvement measures and suggestions should be put forward in the way of supervision. Should adopt diversified supervision mode, to regularly check on the time scale should be to develop inspection cycle according to the individual differences of commercial subject, and with the random irregular to achieve the main commercial inspection, design from the credit system in the supervision system. The regulatory body should be further diversified into consumer and commercial subject to the supervision of the main body, promote the establishment of a complete market self-discipline mechanism. In the regulatory environment, can be combined with existing technology. At the same time, through the continuous improvement of the relevant laws and regulations, to further promote the improvement of business supervision.
