我國中小學未成年學生受傷害事故與教育預防的初探

【摘要】： 隨著獨生子女家庭的增多，人民群眾法律意識的增強，中小學未成年 學生受傷害事故案越來越受到社會輿論的關注。在此情勢下，學校教育面 臨著巨大的壓力。眾多教育工作者希望通過明辨中小學學校傷害事故的責 任和義務，尋找解決中小學學校傷害事故的理想之舉。從學校教育預防人 手，采取主動的姿態(tài)，防止或減少學校傷害事故發(fā)生即是一條防患于未然 的有效措施。本文試以此觀點為導向，以大量文獻調(diào)查資料為依據(jù)，，從教 育法學的角度探討當前我國中小學未成年學生受傷害事故的類型，分析當 前引起傷害事故發(fā)生的原因，并對如何加強學校教育預防，防止、減少傷 害事故的發(fā)生提出自己的看法。 全文分三個部分。 第一部分，我國中小學未成年學生受傷害事故的類型與發(fā)生的原因。 第二部分，從當前對學校傷害事故的處理爭議看學校教育預防的必然 性。 第三部分，從改變易于誘發(fā)學校傷害事故的主觀因素和客觀環(huán)境出發(fā) 對學校教育預防提出對策。
[Abstract]:With the increase of one-child families and the strengthening of the people's legal consciousness, the cases of minor students' injuries in primary and secondary schools are paid more and more attention by the public opinion. In this situation, school education faces tremendous pressure. Many educators hope to find the ideal way to solve the injury accident in primary and middle schools by distinguishing the responsibility and duty of injury accident in primary and middle schools. From the school education to prevent human hand, take the initiative posture, Preventing or reducing school injuries is an effective preventive measure. Based on a large number of literature investigations, this paper attempts to explore the types of injury accidents of underage students in primary and secondary schools in China from the angle of teaching and education law. To analyze the causes of injury accidents before, and how to strengthen the school education to prevent, To reduce the incidence of injury accidents and put forward their own views. The full text is divided into three parts. The first part is about the types and causes of minor students'injuries in primary and secondary schools. In the second part, the necessity of school education prevention is discussed from the dispute of dealing with school injury accident. The third part puts forward the countermeasures to prevent school education from changing the subjective factors and objective environment which are apt to induce school injury accidents.
