體育賽事視聽傳播中的權(quán)利配置與法律保護(hù)

【摘要】：伴隨著數(shù)字傳播技術(shù)的不斷發(fā)展、融合,體育賽事視聽傳播產(chǎn)業(yè)在整個(gè)國民經(jīng)濟(jì)發(fā)展中發(fā)揮著不容忽視的重要作用,已成為我國體育產(chǎn)業(yè)的核心組成部分。我國體育賽事視聽傳播中的權(quán)利配置障礙與司法保護(hù)困境,已嚴(yán)重阻礙到我國體育產(chǎn)業(yè)的健康快速發(fā)展。我國應(yīng)借鑒歐盟關(guān)于體育賽事視聽傳播利益的多元分離保護(hù)模式,依據(jù)賽事傳播的不同階段,區(qū)分不同權(quán)利主體(賽事組織者、授權(quán)制作者及播放組織)的財(cái)產(chǎn)利益。在立法層面上,我國應(yīng)立足于本土傳統(tǒng)文化與法律實(shí)踐,修訂《體育法》使之與民法體系相銜接,同時(shí)進(jìn)一步完善《著作權(quán)法》和《反不正當(dāng)競爭法》的相關(guān)內(nèi)容,全面保護(hù)體育賽事視聽傳播利益,進(jìn)而有效保障體育產(chǎn)業(yè)的健康快速發(fā)展。
[Abstract]:With the continuous development and integration of digital communication technology, the audio-visual communication industry of sports events plays an important role that can not be ignored in the development of the whole national economy, and has become the core component of the sports industry in China. The obstacles of rights allocation and judicial protection in the audio-visual communication of sports events in China have seriously hindered the healthy and rapid development of the sports industry in China. Our country should draw lessons from the European Union's multiple separate protection mode of the audio-visual communication interests of sports events, and distinguish the property interests of different rights subjects (event organizers, authorized producers and broadcasting organizations) according to the different stages of sports events communication. On the legislative level, China should base itself on the local traditional culture and legal practice, amend the Sports Law to link up with the civil law system, and further improve the relevant contents of the copyright Law and the Anti-unfair Competition Law. Fully protect the interests of audio-visual communication of sports events, and then effectively ensure the healthy and rapid development of the sports industry.
