【摘要】：國際體育仲裁院(CAS)為國際奧林匹克委員會、國際單項體育聯(lián)合會、運動員等提供了包括仲裁在內(nèi)的替代性糾紛解決服務,組織結構決定了其裁決難以達致程序和實體正義。作為法律服務體育的重要領域,CAS的仲裁體系極大損害了當事人特別是運動員的仲裁權益。我國未來體育仲裁體系構建應以維護體育比賽的持續(xù)性、保護運動員的合法權利、追求程序和實體正義為目標,保證仲裁組織結構設計合理,均衡司法滲透,遵從當事人意愿、兼顧效率,尊重合理期待和保障當事人充分參審權,助推仲裁程序和仲裁結果達致"接近正義",推動"依法治體"有序發(fā)展。
[Abstract]:The International Sports Arbitration Court (CAS) provides alternative dispute resolution services including arbitration for the International Olympic Committee, the International Federation of individual Sports, athletes and so on. The organizational structure determines that its ruling is difficult to achieve procedural and substantive justice. As an important field of legal service sports, CAS arbitration system has greatly damaged the arbitration rights and interests of the parties, especially the athletes. China's future sports arbitration system should aim at maintaining the sustainability of sports competition, protecting the legitimate rights of athletes, pursuing procedure and substantive justice, ensuring the reasonable design of arbitration organization structure, balanced judicial penetration, and complying with the wishes of the parties. We should give consideration to efficiency, respect reasonable expectation and guarantee the parties' right to participate in the trial, push the arbitration procedure and the result of arbitration to "approach justice", and promote the orderly development of "governing by law".
