【摘要】：體育賽事網(wǎng)絡(luò)轉(zhuǎn)播的法制化是現(xiàn)代體育傳媒發(fā)展的必然要求。隨著網(wǎng)絡(luò)轉(zhuǎn)播技術(shù)的發(fā)展,體育產(chǎn)業(yè)迎來發(fā)展的新機(jī)遇,各大媒體爭相搶奪體育賽事轉(zhuǎn)播權(quán)。但是,體育賽事網(wǎng)絡(luò)轉(zhuǎn)播中的一系列法律問題也不斷顯現(xiàn)出來。體育賽事節(jié)目、體育賽事轉(zhuǎn)播權(quán)在立法上的缺失,部分體育賽事網(wǎng)絡(luò)轉(zhuǎn)播行為不在《著作權(quán)法》保護(hù)范圍內(nèi),使得權(quán)利人維權(quán)時遭遇困境。由于網(wǎng)絡(luò)執(zhí)法部門間缺乏有效協(xié)調(diào)、網(wǎng)絡(luò)執(zhí)法取證難,體育賽事網(wǎng)絡(luò)盜播的打擊力度十分有限。此外,網(wǎng)絡(luò)轉(zhuǎn)播行業(yè)缺乏規(guī)范性、社會公眾版權(quán)保護(hù)意識淡薄嚴(yán)重阻礙了體育賽事網(wǎng)絡(luò)轉(zhuǎn)播的法制化。立足體育賽事網(wǎng)絡(luò)轉(zhuǎn)播實(shí)踐,文章分別從直播和轉(zhuǎn)播兩個層面對體育賽事網(wǎng)絡(luò)轉(zhuǎn)播的含義及其相關(guān)的法律性質(zhì)作出了界定,并對體育賽事網(wǎng)絡(luò)轉(zhuǎn)播法制化作出必要性分析。文章針對體育賽事網(wǎng)絡(luò)轉(zhuǎn)播法制化中存在的問題,在借鑒歐美相關(guān)法律制度的基礎(chǔ)上,分別從立法、執(zhí)法、守法三個方面提出相應(yīng)的完善對策。國家應(yīng)出臺相應(yīng)司法解釋明確體育賽事節(jié)目屬于"以類似攝制電影的方法創(chuàng)作的作品",在《體育法》中明確規(guī)定體育賽事轉(zhuǎn)播權(quán),將"有線廣播"、網(wǎng)絡(luò)媒體納入《著作權(quán)法》保護(hù)范圍。同時要加強(qiáng)網(wǎng)絡(luò)執(zhí)法部門間的統(tǒng)一協(xié)調(diào),提高網(wǎng)絡(luò)執(zhí)法部門的取證技術(shù)水平,嚴(yán)厲打擊體育賽事網(wǎng)絡(luò)盜播行為。"互聯(lián)網(wǎng)體育知識產(chǎn)權(quán)保護(hù)聯(lián)盟"要設(shè)立章程,增強(qiáng)自身規(guī)范性,同時要加強(qiáng)對社會公眾版權(quán)保護(hù)的宣傳教育。
[Abstract]:The legalization of network broadcasting of sports events is the inevitable requirement of the development of modern sports media. With the development of network broadcasting technology, the sports industry ushered in a new opportunity for development, and the major media scrambled for the broadcasting rights of sports events. A series of legal problems in the network broadcasting of sports events are also emerging. The lack of legislation on the right to broadcast sports events and the lack of the right to broadcast sports events, and some acts of network broadcasting of sports events do not fall within the scope of protection under the copyright Law. Because of the lack of effective coordination among the law enforcement departments on the network and the difficulty of obtaining evidence through the network, the crackdown on network theft of sports events is very limited. In addition, the network broadcasting industry lacks standardization. The weak awareness of public copyright protection seriously hinders the legalization of network broadcasting of sports events. This paper defines the meaning and the related legal nature of the network broadcasting of sports events from the two aspects of live broadcast and broadcast respectively. The article aims at the problems existing in the legalization of the network broadcasting of sports events, on the basis of drawing lessons from the relevant legal systems of Europe and the United States, separately from the legislation, enforcement, Three aspects of law-abiding measures are put forward. The country should introduce the corresponding judicial interpretation to make it clear that sports event programs belong to "works created by the method of making movies similar to", and that the right to broadcast sports events is clearly stipulated in the Sports Law. "Cable broadcasting" and network media should be brought into the scope of protection of the copyright Law. At the same time, it is necessary to strengthen the unity and coordination among the law enforcement departments on the network, so as to raise the level of forensics technology of the network law enforcement departments. The Internet Sports intellectual property Protection Union should set up articles of association, strengthen its own standards, and strengthen the publicity and education of the copyright protection of the public at the same time.
