【摘要】：對于公民來講,隱私權(quán)是一項(xiàng)最為基本的權(quán)利,大學(xué)生作為一個(gè)社會特殊群體,對于隱私權(quán)的關(guān)注更高,他們更加注重對于隱私權(quán)的保護(hù),同時(shí),對于侵犯隱私權(quán)的行為存在較大的抵觸。然而,目前我國高校管理模式仍然比較滯后。在這種背景下,本文重點(diǎn)研究國內(nèi)高校在大學(xué)生隱私權(quán)保護(hù)問題及相應(yīng)的解決對策。 本文主要運(yùn)用訪談和問卷調(diào)查的方式從大學(xué)生隱私權(quán)的內(nèi)涵和特征、大學(xué)生隱私權(quán)與高校公開管理的沖突以及高校學(xué)生隱私權(quán)保護(hù)的現(xiàn)狀等幾個(gè)方面分析了高校學(xué)生隱私權(quán)保護(hù)的現(xiàn)實(shí)性和必要性。最后,從法律制度、體制機(jī)制保護(hù)、法律意識和主體意識以及救濟(jì)途徑建設(shè)等五個(gè)方面來探究高校加強(qiáng)學(xué)生隱私權(quán)保護(hù)的對策與建議。
[Abstract]:For citizens, the right to privacy is the most basic right. As a special social group, college students pay more attention to the right of privacy, they pay more attention to the protection of the right of privacy, at the same time, However, the management mode of colleges and universities in China is still lagging behind. Under this background, this paper focuses on the protection of the privacy of college students in China and the corresponding solutions. This paper mainly uses interviews and questionnaires to analyze the connotation and characteristics of college students' right to privacy. This paper analyzes the reality and necessity of college students' privacy protection from the aspects of the conflict between college students' privacy right and the open management of colleges and universities, as well as the present situation of college students' privacy protection. This paper probes into the countermeasures and suggestions of strengthening the protection of students' right to privacy in the five aspects of legal consciousness and subjective consciousness as well as the construction of relief ways.
