GATS框架下我國涉外遠(yuǎn)程教育相關(guān)法律政策研究

【摘要】:2001年我國加入世界貿(mào)易組織(wTo),并承諾開放教育服務(wù)市場。遠(yuǎn)程教育作為教育服務(wù)貿(mào)易的一個細(xì)分市場,隨著信息技術(shù)的飛速發(fā)展呈現(xiàn)出一派欣欣向榮之勢。許多國家不再是被動地在國內(nèi)為他國提供跨國遠(yuǎn)程教育服務(wù),而是主動出擊尋求更多的發(fā)展機(jī)會,這勢必會對我國的遠(yuǎn)程教育市場帶來一定的沖擊。入世十多年來,我國不斷地制定和完善相關(guān)的國內(nèi)法規(guī),這不僅是為了履行《服務(wù)貿(mào)易總協(xié)定》(GATS)中我國具體承諾所承擔(dān)的義務(wù),更是為了構(gòu)建一道保護(hù)我國教育服務(wù)市場的屏障。因此,本文旨在結(jié)合我國在GATS中的具體承諾和現(xiàn)有涉外遠(yuǎn)程教育法律政策,對完蔣我國涉外遠(yuǎn)程教育法律從四部分進(jìn)行闡述、分析。 第一部分包括兩個方面的內(nèi)容:遠(yuǎn)程教育的國際發(fā)展我國遠(yuǎn)程教育的發(fā)展現(xiàn)狀,闡釋我國涉外遠(yuǎn)程教育存在的必然性。 第二部分首先界定了本文對涉外遠(yuǎn)程教育的定義,結(jié)合具體實(shí)例將涉外遠(yuǎn)程教育分為四個類型:跨國遠(yuǎn)程教育、境外設(shè)立遠(yuǎn)程教育機(jī)構(gòu)、遠(yuǎn)程教育國際合作項(xiàng)目和國際直接投資;然后根據(jù)GATS中國際服務(wù)貿(mào)易的定義分別對四類涉外遠(yuǎn)程教育分析確定它們的提供模式,其中跨國遠(yuǎn)程教育和遠(yuǎn)程教育國際合作項(xiàng)目屬于跨境交付模式,境外設(shè)立遠(yuǎn)程教育機(jī)構(gòu)和國際直接投資屬于商業(yè)存在模式;最后對涉外遠(yuǎn)程教育的特點(diǎn)進(jìn)行分析。 第三部分是本文的重點(diǎn),從國際法和國內(nèi)法兩個層面分析我國涉外遠(yuǎn)程教育的相關(guān)法律政策,剖析現(xiàn)有法律存在的問題。國際法層面主要是結(jié)合GATS與我國服務(wù)貿(mào)易具體承諾減讓農(nóng),分析我國對涉外遠(yuǎn)程教育作出的具體承諾以及制定國內(nèi)法規(guī)時應(yīng)該遵守的GATS原則:透明度、國內(nèi)規(guī)定和最惠國待遇原則。國內(nèi)法層面則從法律、國務(wù)院行政法規(guī)、部門規(guī)章和其他規(guī)范性文件四個層次依次篩選分析影響我國涉外遠(yuǎn)程教育的法律文件,主要有《教育法》、《民辦教育促進(jìn)法》、《中外合作辦學(xué)條例》、《中外合作辦學(xué)條例實(shí)施辦法》、《教育網(wǎng)站和網(wǎng)校暫行管理辦法》以及一項(xiàng)學(xué)歷認(rèn)證的歧視性措施。結(jié)合涉外遠(yuǎn)程教育自身的特點(diǎn),研究我國涉外遠(yuǎn)程教育對這些法律廣件的適用以及不同于其他教育服務(wù)貿(mào)易的情況。 第四部分包括三個方面的內(nèi)容,首先提出涉外遠(yuǎn)程教育立法的基本原則:GATS原則、綜合立法原則、國際合作原則;然后針對我國涉外遠(yuǎn)程教育現(xiàn)有法律存在的問題提出一些立法建議;最后為了我國在GATS的下一步談判中能夠確立更完善的規(guī)則,就開放我國教育市場和利用緊急保障措施提出自己的看法。
[Abstract]:In 2001, China joined the World Trade Organization (WTO) and promised to open the education service market. Distance education is a market segment of education service trade. With the rapid development of information technology, many countries no longer passively provide transnational distance education services for other countries, but take the initiative to seek more development opportunities. This will certainly bring certain impact to the distance education market of our country. After entering WTO for more than ten years, our country has made and perfected the related domestic laws and regulations continuously. This is not only to fulfill the obligations of China's specific commitments in GATS, but also to build a barrier to protect our educational service market. The purpose of this paper is to explain and analyze Jiang's foreign distance education law from four parts, combining with our country's specific commitment in GATS and the existing foreign distance education law policy. The first part includes two aspects: the international development of distance education, the present situation of distance education in China, and the inevitability of the existence of distance education in China. The second part defines the definition of distance education in this paper, and divides the distance education into four types: transnational distance education, setting up distance education institutions abroad. International cooperation projects and international direct investment in distance education; Then, according to the definition of international trade in services in GATS, four kinds of foreign distance education are analyzed to determine their modes of providing, in which transnational distance education and distance education international cooperation projects belong to cross-border delivery mode. Overseas establishment of distance education institutions and international direct investment belong to the mode of commercial existence; Finally, the characteristics of distance education involving foreign affairs are analyzed. The third part is the focus of this paper, from the two aspects of international law and domestic law analysis of foreign distance education in China's relevant legal policies. The main aspect of international law is the combination of GATS and China's service trade specific commitment to concessional agriculture. This paper analyzes the specific commitments made by our country to distance education concerning foreign affairs and the GATS principles that should be observed when making domestic laws and regulations: transparency, domestic regulations and most-favoured-nation treatment principles. The four levels of administrative regulations, departmental regulations and other normative documents of the State Council are selected and analyzed in turn, including the Education Law and the Law on the Promotion of Civilian-run Education. The regulations on Sino-foreign Cooperation in running Schools, the measures for the implementation of the regulations on Chinese-foreign Cooperation in running Schools, the interim measures for the Administration of Educational websites and online Schools, and a discriminatory measure for the certification of academic qualifications, combined with the characteristics of distance education concerning foreign affairs. This paper studies the application of foreign distance education to these laws and the situation that it is different from other educational service trade. The 4th part includes three aspects: firstly, it puts forward the basic principle of foreign distance education legislation: the principle of: Gats, the principle of comprehensive legislation and the principle of international cooperation; Then some legislative suggestions are put forward in view of the problems existing in the existing law of distance education involving foreign affairs in our country. Finally, in order to establish more perfect rules in the next negotiation of GATS, the author puts forward his own views on opening up the education market and utilizing the emergency safeguard measures in our country.
