美國大學(xué)章程中的教師權(quán)利與責(zé)任研究

【摘要】:隨著《高等學(xué)校章程制定暫行辦法》的頒布,近年來,我國大學(xué)章程的制定如火如荼地進行,各大學(xué)陸續(xù)出臺了本校的大學(xué)章程。美國大學(xué)章程是美國高等教育依法治校的依據(jù)和必然產(chǎn)物,也是大學(xué)成員合法權(quán)益保障的“最高法”。本文選取了康涅狄格大學(xué)等16所美國大學(xué)的大學(xué)章程作為研究對象,以文獻法、比較法為研究方法,通過對16部大學(xué)章程文本進行比較、分析、歸納,就章程中教師的權(quán)利、責(zé)任以及相應(yīng)的維權(quán)和問責(zé)流程的內(nèi)容進行梳理并得出特點,結(jié)合我國大學(xué)章程中教師權(quán)利與責(zé)任的現(xiàn)狀,試圖為我國大學(xué)完善教師權(quán)利與責(zé)任體系提供一些啟示。筆者分別從教師權(quán)利和教師責(zé)任兩個維度對16部美國大學(xué)章程的文本進行研究,接著,就教師權(quán)利與責(zé)任相應(yīng)的維權(quán)和問責(zé)流程對16部美國大學(xué)章程進行研究和梳理。通過研究發(fā)現(xiàn):美國大學(xué)章程條款中集中涉及到平等權(quán)等11項教師權(quán)利,章程中教師權(quán)利的規(guī)定具有參與廣泛、規(guī)定具體、各有特色的特點。美國大學(xué)章程中的教師責(zé)任包括自我責(zé)任、對他人的責(zé)任和社會責(zé)任三類,章程中教師責(zé)任的規(guī)定體現(xiàn)出責(zé)任與權(quán)利相伴、內(nèi)容系統(tǒng)具體、重視社會責(zé)任的特點。美國大學(xué)章程中教師維權(quán)和問責(zé)的規(guī)定的特點是有獨立的受審機構(gòu)、整個流程規(guī)范具體、教師權(quán)利授予充分。鑒于此,筆者對所選取的10部我國大學(xué)章程中的教師權(quán)利、責(zé)任及相應(yīng)的維權(quán)和問責(zé)機制進行分析,發(fā)現(xiàn)我國大學(xué)章程存在教師權(quán)利和義務(wù)內(nèi)容不夠具體和全面、校內(nèi)維權(quán)和問責(zé)機制不夠健全等問題,最后提出為完善我國大學(xué)教師權(quán)利與責(zé)任體系的經(jīng)驗和啟示。
[Abstract]:With the promulgation of the Provisional measures for the Establishment of the articles of Association of Colleges and Universities, in recent years, the constitution of universities in our country is in full swing, and each university has issued its university regulations one after another. The constitution of American universities is the basis and inevitable product of American higher education governing by law, and it is also the supreme law of protecting the legitimate rights and interests of university members. This paper selects the articles of association of 16 American universities such as the University of Connecticut as the research object, takes the literature law and the comparative law as the research method, through carries on the comparison, the analysis, the induction to 16 university charter texts, summarizes, regarding the teacher's rights in the charter. The content of responsibility and the corresponding rights and accountability processes are combed and the characteristics are obtained. Combined with the status quo of teachers' rights and responsibilities in the university charter of our country, this paper tries to provide some enlightenment for our universities to perfect the system of teachers' rights and responsibilities. The author studies the texts of 16 American university statutes from the two dimensions of teacher rights and teachers' responsibilities. Then, the author studies and combs the 16 American university statutes on the corresponding rights and responsibilities of teachers' rights and responsibilities. Through the research, it is found that 11 items of teachers' rights such as equal rights are involved in the articles of association of American universities, and the provisions of the articles of association have the characteristics of extensive participation, specific provisions and distinctive features. The teacher's responsibility in the charter of American university includes three kinds: self-responsibility, responsibility to others and social responsibility. The regulation of teacher's responsibility in the charter embodies the characteristics of responsibility and rights, concrete content system and attaching importance to social responsibility. The characteristics of the regulation of teachers' rights and accountability in American university charter are that there are independent institutions of trial, the whole process is standardized and concrete, and the teachers' rights are granted adequately. In view of this, the author analyzes the teachers' rights, responsibilities and corresponding rights and accountability mechanisms in the 10 articles of association of our universities, and finds that the contents of teachers' rights and obligations are not specific and comprehensive enough. The internal rights protection and accountability mechanism is not perfect. Finally, the author puts forward the experience and inspiration for perfecting the system of university teachers' rights and responsibilities.
