當代大學(xué)生法治意識養(yǎng)成研究

【摘要】：黨的十八大以來,我國迎來了法治發(fā)展的新春天。黨的十八屆四中全會對我國法治社會的建設(shè)和發(fā)展進行了一系列安排,開啟了我國法治發(fā)展的新征途,這也在廣大青年學(xué)生中引起了廣泛關(guān)注和討論。當代大學(xué)生應(yīng)該積極投身到社會主義法治建設(shè)這項事業(yè)當中去,這就在一定程度上要求大學(xué)生具備相應(yīng)的法治意識。大學(xué)生作為國家建設(shè)的棟梁之才,其法治意識水平的高低關(guān)系到我國法治社會建設(shè)進程的快慢。正是在這一時代背景下,大學(xué)生法治意識養(yǎng)成的理論研究和實踐工作是急需重點關(guān)注的課題。本研究立足于依法治國的全新時代,以大學(xué)生法治意識養(yǎng)成的相關(guān)概念和相關(guān)理論為切入點,堅持以馬克思主義的世界觀和方法論為指導(dǎo),闡述了大學(xué)生法治意識養(yǎng)成的必要性和可行性;通過實證分析,全面把握當代大學(xué)生法治意識和法治意識養(yǎng)成的現(xiàn)狀,著重對大學(xué)生法治意識現(xiàn)狀中的已有成效和存在的主要問題進行了分析和研究,找到了制約當代大學(xué)生法治意識養(yǎng)成的癥結(jié)所在,最終提出了大學(xué)生法治意識養(yǎng)成的實踐路徑。本文共包括六部分的內(nèi)容。第一部分是導(dǎo)論,主要闡述了本課題研究的背景、意義、國內(nèi)外研究現(xiàn)狀、創(chuàng)新之處和存在的問題以及研究方法。第二部分主要大學(xué)生法治意識養(yǎng)成的相關(guān)概念進行了界定,并對大學(xué)生法治意識養(yǎng)成的主要內(nèi)容和理論基礎(chǔ)進行了闡述。第三部分主要論述了大學(xué)生法治意識養(yǎng)成的必要性與可行性。從推動我國法治社會建設(shè)的必然要求、社會主義市場經(jīng)濟的客觀需要、高校思想政治教育的重要任務(wù)以及大學(xué)生健康成長的必備條件這四個方面論述了大學(xué)生法治意識養(yǎng)成的必要性;從社會法治環(huán)境產(chǎn)生良好氛圍、傳統(tǒng)思想道德發(fā)揮積極作用、思想政治教育提供基本條件以及大學(xué)生自身擁有有利因素四個方面論述了大學(xué)生法治意識養(yǎng)成的可行性。第四部分主要對大學(xué)生法治意識現(xiàn)狀進行了實證分析,提出了大學(xué)生法治意識養(yǎng)成的已有成效,即具備基本的法律知識,關(guān)心國家法治建設(shè)和積極投身國家法治建設(shè);在調(diào)查的基礎(chǔ)上,找到了大學(xué)生法治意識現(xiàn)狀中存在的主要問題,有大學(xué)生法律知識單薄、法律權(quán)威意識不夠、憲法意識不足、權(quán)利義務(wù)意識淡薄和法律信仰不牢固這五個方面的問題;第五部分對大學(xué)生法治意識養(yǎng)成存在問題的成因進行了詳細探討;原因主要有歷史文化傳統(tǒng)的影響、社會現(xiàn)實的制約、學(xué)校教育和管理的影響、家庭教育的影響和大學(xué)生自身因素的制約。第六部分主要從構(gòu)建中國特色社會主義法治資源、明確大學(xué)生法治意識養(yǎng)成的目標和任務(wù)、重視能夠適應(yīng)大學(xué)生法治意識養(yǎng)成的教育、營造能夠促進大學(xué)生法治意識養(yǎng)成的良好環(huán)境以及推動大學(xué)生法治意識的自我養(yǎng)成這五個方面提出了大學(xué)生法治意識養(yǎng)成的路徑。
[Abstract]:Since the 18th Party Congress, China has ushered in a new spring of the development of the rule of law. The fourth Plenary session of the 18th CPC Central Committee made a series of arrangements for the construction and development of the society ruled by law in our country, which opened up a new journey for the development of the rule of law in our country, which also aroused widespread concern and discussion among the vast number of young students. Contemporary college students should actively devote themselves to the cause of socialist legal construction, which to a certain extent requires college students to have the corresponding consciousness of rule of law. As the pillars of national construction, the level of college students' awareness of the rule of law is related to the speed of the construction of our country's legal society. It is against this background that the theoretical research and practical work on the cultivation of college students' consciousness of rule of law is a subject that needs to be paid close attention to. This study is based on the new era of governing the country according to law, with the relevant concepts and theories developed by college students' consciousness of rule of law as the starting point, and insists on the guidance of Marxist world outlook and methodology. This paper expounds the necessity and feasibility of cultivating the consciousness of ruling by law of college students, and, through the empirical analysis, comprehensively grasps the present situation of the consciousness of rule of law and the cultivation of consciousness of rule of law of contemporary college students. This paper focuses on the analysis and study of the existing achievements and main problems in the present situation of college students' awareness of the rule of law, finds out the crux of restricting the cultivation of contemporary college students' awareness of the rule of law, and finally puts forward the practical path for the cultivation of the consciousness of ruling by law of college students. This paper includes six parts. The first part is the introduction, mainly elaborated this topic research background, the significance, the domestic and foreign research present situation, the innovation and the existence question as well as the research method. The second part defines the related concepts of the cultivation of college students' awareness of the rule of law, and expounds the main content and theoretical basis of the cultivation of the awareness of the rule of law of college students. The third part mainly discusses the necessity and feasibility of the cultivation of college students'consciousness of rule of law. From the inevitable requirements of promoting the construction of a society ruled by law in our country, the objective needs of the socialist market economy, The important task of ideological and political education in colleges and universities and the necessary conditions for the healthy growth of college students are discussed in four aspects: the necessity of cultivating students' consciousness of rule of law, the creation of a good atmosphere from the social environment of ruling by law, and the positive role of traditional ideology and morality. This paper discusses the feasibility of cultivating the consciousness of rule of law in college students from four aspects: the basic conditions of ideological and political education and the favorable factors of college students' own possession. The fourth part mainly carries on the demonstration analysis to the university student legal consciousness present situation, has proposed the university student rule of law consciousness cultivation already the result, namely has the basic legal knowledge, cares about the national rule of law construction and actively participates in the national rule of law construction; On the basis of the investigation, the author finds out the main problems existing in the present situation of university students' consciousness of rule of law, such as weak knowledge of law, insufficient consciousness of legal authority, insufficient consciousness of constitution, etc. The fifth part discusses in detail the causes of the problems existing in the cultivation of university students' awareness of the rule of law; the main reasons are the influence of historical and cultural tradition, the restriction of social reality. The influence of school education and management, the influence of family education and the restriction of college students themselves. The sixth part mainly from the construction of socialist legal resources with Chinese characteristics, clear the goal and task of college students' awareness of the rule of law, attach importance to the education that can adapt to the cultivation of the awareness of the rule of law of college students. This paper puts forward the way to cultivate the consciousness of rule of law in college students from the five aspects of creating a good environment which can promote the cultivation of the consciousness of rule of law of college students and the self-cultivation of the consciousness of rule of law of college students.
