美國(guó)州政府高等教育的治理機(jī)構(gòu)及其組織設(shè)計(jì)

【摘要】:研究對(duì)高等教育具有直接管理權(quán)的州政府的高等教育治理機(jī)構(gòu)及其組織設(shè)計(jì)對(duì)正確認(rèn)識(shí)和深入了解美國(guó)政府與大學(xué)的關(guān)系及其權(quán)力邊界具有重要的基礎(chǔ)性作用。通過(guò)重點(diǎn)對(duì)美國(guó)州行政、立法、司法三大政府機(jī)關(guān)中有關(guān)高等教育的主治機(jī)構(gòu)或治理主體的考察及其組織設(shè)計(jì)的描述,歸納出了上述三類(lèi)高等教育治理機(jī)構(gòu)的主要權(quán)力清單。研究發(fā)現(xiàn),美國(guó)州政府是高等教育名副其實(shí)的責(zé)任主體,其保留了監(jiān)管大學(xué)尤其是公立大學(xué)的主要責(zé)任,其行使的高等教育公共治理權(quán)具有多元、復(fù)雜、直接和廣泛的特性。政府如何在高等教育治理機(jī)構(gòu)的組織設(shè)計(jì)中設(shè)定符合國(guó)情的權(quán)力特性,從而使大學(xué)在公共利益的軌道上按照高等教育的規(guī)律獲得更大的發(fā)展空間值得進(jìn)一步深入探討。
[Abstract]:The study of the higher education governance institutions and their organizational design of the state government which has direct management power over higher education plays an important and fundamental role in correctly understanding and deeply understanding the relationship between the United States government and universities and their power boundaries. The main powers of the three kinds of higher education governing institutions are summarized through the investigation and the description of the organization and design of the governing bodies or the governing bodies of the higher education in the three major government organs of the State Administration, legislation and Justice in the United States, and the main power lists of the above three types of higher education governance institutions are summarized. It is found that the American state government is the responsibility subject of higher education, which retains the main responsibility of supervising universities, especially public universities. The public governance power of higher education exercised by the state government is diverse, complex, direct and extensive. How the government sets up the power characteristic according to the national conditions in the organization design of the higher education governance institution, so that the university in the track of public interest can get more development space according to the law of higher education, it is worth further discussion.
