【摘要】：日本司法考試與法學(xué)教育起源于明治維新,經(jīng)歷初創(chuàng)、確立、變革等不同階段。而兩者的關(guān)系若即若離,既有井水不犯河水的時期,也有十分親密的時代。2001年6月12日發(fā)布的《日本司法改革審議會意見書——支撐21世紀(jì)日本的司法制度》作為新一輪司法改革的風(fēng)向標(biāo),在革新法學(xué)教育方面推行"法科大學(xué)院",企圖營造法學(xué)教育與司法考試的"蜜月關(guān)系",只是實踐的結(jié)果有違初衷。日本改革法學(xué)教育和司法考試的諸多得失,對如何協(xié)調(diào)和處理我國法學(xué)教育與國家統(tǒng)一法律職業(yè)資格考試的關(guān)系有著一定的啟示和可資借鑒之處。
[Abstract]:Japanese judicial examination and law education originated from the Meiji Restoration, experienced different stages of establishment, establishment and reform. And if the relationship between the two is so distant, there is a period in which the well water does not intrude on the river, There are also very close times. On June 12, 2001, the opinion of Japan's Judicial Reform Review Conference-supporting Japan's judicial system in the 21st century-served as a bellwether for a new round of judicial reform. In the aspect of innovating the law education, the institute of law science and technology is carried out in an attempt to create the honeymoon relationship between the law education and the judicial examination, but the result of practice is contrary to the original intention. The reform of law education and judicial examination in Japan has some implications for how to coordinate and deal with the relationship between China's legal education and the national unified legal professional qualification examination.
