【摘要】：清末民初法科留學(xué)潮大致歷經(jīng)了晚清政府時期、北洋政府時期、國民政府時期三個階段,歷經(jīng)了從“西洋不如東洋”到“西洋東洋并舉”再到“西洋勝過東洋”的演進。法科留學(xué)生或籌建法政學(xué)堂,或借鑒西學(xué)建構(gòu)中國的法學(xué)體系,或著書辦報弘揚法治思想,或參與立憲修律活動引領(lǐng)法制潮流,或主持警政獄政改革推動法制進程,有力地推動了中國的法學(xué)教育和法制建設(shè)近代化過程。
[Abstract]:At the end of the Qing Dynasty and the beginning of the Republic of China, the tide of studying in law subjects generally went through three stages: the late Qing government, the Beiyang government, and the national government. After the evolution from "the West is not as good as the East" to "the Western Ocean simultaneously developing" to "the Western Ocean is better than the East", the students studying in the field of law either plan to set up a school of law and politics, or learn from western learning to construct a legal system in China, or write books and newspapers to carry forward the idea of the rule of law. Either participating in the constitutional law revision activities to lead the trend of the legal system, or presided over the reform of the police prison system to promote the legal process, has contributed to the modernization of legal education and legal construction in China.
