名實(shí)分離:雙重約束下的地方政府行為策略

【摘要】:名實(shí)分離現(xiàn)象長(zhǎng)期且普遍存在于地方政府權(quán)力運(yùn)行過(guò)程,這一現(xiàn)象是地方政府在法律軟約束與經(jīng)濟(jì)硬約束不平衡情境下的一種行為策略。本文構(gòu)建了情境-過(guò)程的分析框架,通過(guò)對(duì)組織外情境、組織內(nèi)情境、行動(dòng)者、行動(dòng)結(jié)果四個(gè)基本要素加以分析,揭示了地方政府權(quán)力過(guò)程名實(shí)分離現(xiàn)象的產(chǎn)生機(jī)理,并通過(guò)個(gè)案研究對(duì)此進(jìn)行了驗(yàn)證。地方政府權(quán)力過(guò)程的名實(shí)分離行為是其處理多元任務(wù)困境時(shí),通過(guò)對(duì)組織內(nèi)外情境加以理性判斷后的選擇。一方面,法律軟約束與經(jīng)濟(jì)硬約束的組織外情境,促使地方政府形成"經(jīng)濟(jì)優(yōu)先、兼顧法治"的治理邏輯;另一方面,在這種邏輯下,地方政府對(duì)組織內(nèi)情境進(jìn)行局部重構(gòu),使其與外部情境相協(xié)調(diào),形成效率優(yōu)先的權(quán)力運(yùn)行規(guī)則。由于權(quán)力運(yùn)行的正式規(guī)則存在缺陷,難以有效實(shí)現(xiàn)效率原則,而非正式規(guī)則因具備靈活高效等優(yōu)勢(shì)而彰顯活力。因此,正式權(quán)力的非正式化運(yùn)作現(xiàn)象大量存在于地方政府的權(quán)力過(guò)程,甚至超越了現(xiàn)有的法律規(guī)定。但法律軟約束并非無(wú)約束,公然違背正式的權(quán)力運(yùn)行程序有可能遭到責(zé)任追究,而名實(shí)分離的行為則因其外在形式的合法律性而被地方政府所青睞,作為規(guī)避違法風(fēng)險(xiǎn)的理性選擇。盡管權(quán)力過(guò)程的名實(shí)分離有其合理性,但暗含權(quán)力非法治化的風(fēng)險(xiǎn),進(jìn)而滋生腐敗、地方政府間合謀等權(quán)力異化問(wèn)題,侵蝕了權(quán)力運(yùn)行的合法性。
[Abstract]:The phenomenon of separation of names and facts exists for a long time and generally exists in the process of the operation of local government power, which is a behavior strategy of local governments in the context of the imbalance between legal soft constraints and economic hard constraints. In this paper, the analysis framework of situation-process is constructed, and the mechanism of the separation of names in the process of local government power is revealed by analyzing the four basic elements of the situation outside the organization, the situation within the organization, the actors and the results of action, which is verified by a case study. The separation of names and facts in the process of local government power is its choice after rationally judging the internal and external situations of the organization when dealing with the dilemma of multiple tasks. On the one hand, the out-of-organization situation of legal soft constraint and economic hard constraint promotes the local government to form the governance logic of "economic priority, taking into account the rule of law"; on the other hand, under this logic, the local government reconstructs the internal situation of the organization, makes it coordinate with the external situation, and forms the power operation rule of giving priority to efficiency. Due to the defects of the formal rules of power operation, it is difficult to effectively realize the principle of efficiency, while the informal rules show vitality because of their advantages of flexibility and efficiency. Therefore, the informal operation of formal power exists in the process of local government power, and even goes beyond the existing legal provisions. However, the soft restriction of law is not unconstrained, and the blatant violation of the formal power operation procedure may be investigated, while the behavior of separation of names and facts is favored by the local government because of the legal nature of its external form, as a rational choice to avoid the illegal risk. Although the separation of names and facts in the process of power has its rationality, it implies the risk of illegal governance of power, and then breeds corruption, collusion between local governments and other issues of power alienation, which erodes the legitimacy of power operation.
