網(wǎng)絡(luò)社團(tuán)公益行為的監(jiān)管研究

【摘要】：科技改變生活,網(wǎng)絡(luò)改變?nèi)藗兘Y(jié)社、集體行動(dòng)和公益慈善模式。互聯(lián)網(wǎng)的發(fā)展與普及、利益的分化、公眾公共精神和公益精神的覺醒催生了網(wǎng)絡(luò)社團(tuán)和網(wǎng)絡(luò)社團(tuán)公益行為的興起。網(wǎng)絡(luò)社團(tuán)是一種新型的社會(huì)組織形式,網(wǎng)絡(luò)社團(tuán)公益行為是一種新型的公益慈善模式。網(wǎng)絡(luò)社團(tuán)公益行為的監(jiān)管是社會(huì)組織監(jiān)管和公益慈善監(jiān)管的重要內(nèi)容,也是網(wǎng)絡(luò)治理的重要內(nèi)容。加強(qiáng)網(wǎng)絡(luò)社團(tuán)公益行為的監(jiān)管研究具有重要的理論意義和現(xiàn)實(shí)意義。參與成本、參與意識(shí)、參與價(jià)值感和信任度是影響人們參與公共事務(wù)和公益慈善的主要因素。網(wǎng)絡(luò)去中心化、跨時(shí)空、便捷、互動(dòng)性與透明度高等特點(diǎn)使網(wǎng)絡(luò)社團(tuán)公益行為部分突破了傳統(tǒng)社會(huì)組織和公益慈善制度的束縛,降低了人們結(jié)社、參與公共事務(wù)的成本,激發(fā)公眾公益熱情,顛覆了傳統(tǒng)公益思維方式,傳播現(xiàn)代公益文化和公益精神,影響公共輿論乃至公共政策,拓展社會(huì)組織公益慈善的發(fā)展空間,壯大社會(huì)組織力量,優(yōu)化國(guó)家—社會(huì)格局。然而,由于現(xiàn)有社會(huì)組織、公益慈善監(jiān)管的法律和政策是基于傳統(tǒng)物理空間所設(shè)計(jì),沒有考慮到網(wǎng)絡(luò)的興起及網(wǎng)絡(luò)化的內(nèi)在要求�，F(xiàn)有法律政策存在制度剩余和制度匱乏雙重困境,簡(jiǎn)單延用傳統(tǒng)社會(huì)組織及其公益監(jiān)管法律和政策,可能會(huì)扼殺或者阻礙網(wǎng)絡(luò)社團(tuán)公益行為的活力。大量網(wǎng)絡(luò)社團(tuán)和網(wǎng)絡(luò)公益活動(dòng)游離于現(xiàn)有法律制度監(jiān)管之外,遭遇身份合法性困境。與此同時(shí),網(wǎng)絡(luò)社團(tuán)社會(huì)監(jiān)督、第三方的專業(yè)監(jiān)督以及網(wǎng)絡(luò)社團(tuán)內(nèi)部治理機(jī)制不健全,損害網(wǎng)絡(luò)社團(tuán)公益行為的公信力,阻礙網(wǎng)絡(luò)社團(tuán)公益快速、可持續(xù)發(fā)展。在社會(huì)組織和公益慈善領(lǐng)域,存在政府失靈、市場(chǎng)失靈或社會(huì)失靈,單一的監(jiān)督管理主體不利于網(wǎng)絡(luò)社團(tuán)公益行為的健康發(fā)展。因此,需要建立政府、社會(huì)、網(wǎng)絡(luò)社團(tuán)自身等多元的監(jiān)督管理體系,實(shí)現(xiàn)政府監(jiān)管與社會(huì)監(jiān)督結(jié)合,專業(yè)監(jiān)督與非專業(yè)監(jiān)督互補(bǔ),他律與自律互動(dòng),最終促進(jìn)網(wǎng)絡(luò)社團(tuán)公益行為有序發(fā)展、良性繁榮。
[Abstract]:Technology changes life, the Internet changes people's association, collective action and charitable patterns. The development and popularization of the Internet, the differentiation of interests, and the awakening of public spirit and public spirit give birth to the rise of the public behavior of the network community and the network association. The network association is a new form of social organization, and the network community public welfare behavior is a new public welfare charity mode. The supervision of network community public welfare behavior is an important content of social organization supervision and charity supervision, and is also an important content of network governance. It is of great theoretical and practical significance to strengthen the supervision and research of network community public welfare behavior. Participation cost, participation consciousness, participation value and trust are the main factors that affect people's participation in public affairs and charity. The characteristics of network decentralization, span of time and space, convenience, interactivity and high transparency make the public welfare behavior of network community break through the shackles of traditional social organization and charity system, and reduce the cost of people's association and participation in public affairs. Arousing public interest enthusiasm, subverting the traditional mode of public welfare thinking, spreading modern public welfare culture and spirit, influencing public opinion and even public policies, expanding the development space of public welfare charity in social organizations, and strengthening the strength of social organizations, Optimize the state-society pattern. However, because of the existing social organizations, the laws and policies of public charity supervision are based on the traditional physical space, and do not take into account the rise of the network and the inherent requirements of the network. The existing legal policy has the double dilemma of institutional surplus and institutional scarcity. Simply using the traditional social organization and its public welfare supervision laws and policies may stifle or hinder the vitality of the network community's public welfare behavior. A large number of network associations and network public welfare activities are separated from the existing legal system, and encounter the dilemma of identity legitimacy. At the same time, the social supervision of the network community, the professional supervision of the third party and the internal governance mechanism of the network association are not perfect, which impair the credibility of the public welfare behavior of the network community, and hinder the rapid and sustainable development of the public welfare of the network society. In the field of social organization and charity, there are government failure, market failure or social failure, and a single supervision and management body is not conducive to the healthy development of network community public welfare behavior. Therefore, it is necessary to establish multiple supervision and management systems, such as government, society, network associations themselves, so as to realize the combination of government supervision and social supervision, the complementarity between professional supervision and non-professional supervision, and the interaction between heteronomy and self-discipline.
