【摘要】：近些年來(lái),隨著我國(guó)經(jīng)濟(jì)體制改革不斷深入,改革開(kāi)放取得了長(zhǎng)足的進(jìn)展,隨之而來(lái)的是城市規(guī)模不斷擴(kuò)大,城市化進(jìn)程不斷深入。因此,城市管理行政執(zhí)法工作的重要性也不斷得到重視。在現(xiàn)階段,雖然城市執(zhí)法工作取得了一些成果,但仍然存在很多不容忽視需要我們花費(fèi)氣力去解決的問(wèn)題。在城市管理執(zhí)法過(guò)程中,所面臨的困難主要是執(zhí)法法律依據(jù)不清晰、執(zhí)法體制不夠完善、執(zhí)法范圍界定不清晰、執(zhí)法者綜合素質(zhì)參差不齊等。所以,對(duì)城市管理行政執(zhí)法的法制基礎(chǔ)進(jìn)行完善、改革城市管理執(zhí)法工作方式、提升城市整體的行政執(zhí)法軟環(huán)境是解決現(xiàn)階段城管執(zhí)法所面臨問(wèn)題的關(guān)鍵所在。本論文是以大連市為研究背景,對(duì)城市管理行政執(zhí)法工作進(jìn)行研究。對(duì)大連市城市管理行政執(zhí)法的實(shí)際情況進(jìn)行調(diào)查和研究,在此基礎(chǔ)上探討出適合大連城市綜合執(zhí)法的改革發(fā)展方向。本論文主要通過(guò)對(duì)城管執(zhí)法為主題、國(guó)內(nèi)國(guó)外研究概況的對(duì)比以及國(guó)內(nèi)其他城市的進(jìn)展進(jìn)行闡述分析,闡明了論文選題的意義,為論文下一步的研究做好了理論鋪墊。以大連市城管執(zhí)法的實(shí)際工作為研究對(duì)象,以事實(shí)為依據(jù),如實(shí)反映和體現(xiàn)現(xiàn)階段大連市城管工作的發(fā)展?fàn)顩r及存在的問(wèn)題。最后在對(duì)大連市城市管理行政執(zhí)法過(guò)程中所面臨的問(wèn)題進(jìn)行闡述的基礎(chǔ)上,分別從立法基礎(chǔ)、各部門(mén)協(xié)作、監(jiān)督約束機(jī)制及執(zhí)法人員能力幾個(gè)方面出發(fā),對(duì)引起問(wèn)題的原因進(jìn)行深層次的分析。與此同時(shí),對(duì)應(yīng)上述因素,本論文在立法建設(shè)、體制改革、培養(yǎng)隊(duì)伍及提升機(jī)制等層面出發(fā),提出了有益于大連市城市管理行政執(zhí)法工作的合理措施,為完善城市管理行政執(zhí)法工作提供了有力的理論參考。
[Abstract]:In recent years, with the deepening of China's economic system reform, the reform and opening up has made considerable progress, followed by the continuous expansion of urban scale and urbanization process. Therefore, the importance of urban management administration law enforcement work has been paid more and more attention. At the present stage, although some achievements have been made in urban law enforcement, there are still many problems that should not be ignored. In the process of urban management law enforcement, the main difficulties are that the legal basis of law enforcement is not clear, the law enforcement system is not perfect, the definition of law enforcement scope is not clear, and the comprehensive quality of law enforcers is not uniform and so on. Therefore, it is the key to solve the problems of urban management law enforcement at present to perfect the legal basis of urban management administrative law enforcement, to reform the working mode of urban management law enforcement, and to promote the overall soft environment of urban administration law enforcement. This paper takes Dalian as the research background, carries on the research to the city management administration law enforcement work. On the basis of investigation and research on the actual situation of Dalian city administration law enforcement, the reform and development direction suitable for Dalian city comprehensive law enforcement is discussed. Through the comparison of domestic and foreign research situation and the progress of other cities, this paper clarifies the significance of the topic of the thesis, and makes a theoretical foundation for the next research. Taking the actual work of urban management law enforcement in Dalian as the object of study and the facts as the basis, the development situation and existing problems of Dalian city management work are reflected and reflected truthfully at the present stage. Finally, on the basis of expounding the problems in the process of administrative law enforcement of Dalian city management, respectively from the legislative basis, the cooperation of various departments, the supervision and restraint mechanism and the ability of law enforcement personnel. Make a deep analysis of the causes of the problem. At the same time, corresponding to the above factors, this paper puts forward some reasonable measures to benefit Dalian city administration law enforcement work in the aspects of legislative construction, system reform, training team and promotion mechanism, and so on. It provides a powerful theoretical reference for perfecting the law enforcement work of urban management administration.
