編外城管隊(duì)員現(xiàn)狀及管理對(duì)策研究

【摘要】:隨著城市化進(jìn)程的加快,城市的發(fā)展對(duì)城市管理提出了更高更細(xì)的要求,而城市管理部門作為政府的一個(gè)職能部門,是城市管理的主體。但是,在國(guó)家提倡行政編制精簡(jiǎn)的情況下,城市管理部門很難利用有限的行政執(zhí)法隊(duì)員去有效的管理城市。例如,深圳,人口達(dá)到1500多萬(wàn),轄區(qū)面積近2000平方公里,而全市真正參與城市管理行政執(zhí)法的正式隊(duì)員只有1200余名,這意味著1名城管執(zhí)法隊(duì)員要管轄1.6萬(wàn)平方公里的1.3萬(wàn)人口。因此,現(xiàn)有的編制內(nèi)城管執(zhí)法隊(duì)員不能應(yīng)對(duì)如此繁重的城市管理任務(wù),需要借助編外城管隊(duì)員的力量。所以,編外城管隊(duì)員走上了工作崗位,并且隊(duì)伍不斷擴(kuò)大,逐漸成為城市管理中不可缺少的力量。但是,由于編外城管隊(duì)員素質(zhì)參差不齊,法律法律意識(shí)淡薄,政府機(jī)關(guān)對(duì)編外城管隊(duì)員的管理也沒有出臺(tái)相對(duì)統(tǒng)一的法律法規(guī)和規(guī)章制度。此外,在編外城管隊(duì)員聘用過(guò)程中也遇到了一系列的問(wèn)題,這其中既有對(duì)編外城管隊(duì)員權(quán)利的侵害,也有因?yàn)榫幫獬枪荜?duì)員在工作過(guò)程中因?yàn)閭(gè)人素質(zhì)差、法律意識(shí)淡薄等因素對(duì)政府部門造成的不利影響。探討解決這些問(wèn)題的對(duì)策,對(duì)于保障編外城管隊(duì)員的權(quán)利,促使城市管理部門對(duì)編外城管隊(duì)員進(jìn)行更有效管理,促進(jìn)城市管理和發(fā)展都具有非常重要的意義。本研究通過(guò)分析北京市、深圳市和寧波市鄞州區(qū)編外城管隊(duì)員基本情況及管理現(xiàn)狀,探討編外城管隊(duì)員在管理中存在的問(wèn)題,分析造成問(wèn)題的原因,在充分剖析目前我國(guó)部分城市編外城管隊(duì)員管理問(wèn)題的基礎(chǔ)上,提出了合理的對(duì)策。本研究選取了北京市、深圳市、寧波市鄞州區(qū)作為樣本進(jìn)行相關(guān)數(shù)據(jù)的收集,所采用的研究方法主要有文獻(xiàn)復(fù)習(xí)法、問(wèn)卷調(diào)查法和訪談法等。本研究涉及編外城管隊(duì)員在管理體制、工資福利、職稱晉升、接受培訓(xùn)等方面的內(nèi)容。探究編外城管隊(duì)員流動(dòng)性大、法律法規(guī)意識(shí)不強(qiáng)、主人翁意識(shí)缺乏等給城市管理帶來(lái)了一定的影響。對(duì)策建議政府機(jī)關(guān)要在制度建設(shè)等方面保障編外城管隊(duì)員的實(shí)體權(quán)利,同時(shí)對(duì)編外城管隊(duì)員的自身層面提出了要求,讓編外城管隊(duì)員更加有凝聚力和歸屬感。
[Abstract]:With the acceleration of the urbanization process, the development of the city has put forward higher and more detailed requirements for urban management. As a functional department of the government, the urban management department is the main body of urban management. However, it is difficult for the city management department to use the limited administrative law enforcement personnel to manage the city effectively. For example, Shenzhen, with a population of more than 15 million and an area of nearly 2000 square kilometers, has only 1200 members of the city who really participate in the administration and law enforcement of the city. This means that a city management law enforcement team to manage 16000 square kilometers of 13000 people. Therefore, the existing urban management law enforcement team can not cope with such a heavy task of urban management, need to rely on the strength of the urban management team. Therefore, the city management team went to work, and the team continued to expand, gradually become an indispensable force in urban management. However, because of the uneven quality and weak legal consciousness, the government organs have not issued relatively uniform laws, regulations and rules for the management of the extra urban management members. In addition, there are also a series of problems encountered in the process of employing non-staff members of urban management, which not only infringe on the rights of non-staff members of urban management, but also because of the poor personal quality in the process of working. Weak legal consciousness and other factors to government departments caused adverse effects. It is of great significance to discuss the countermeasures to solve these problems in order to protect the rights of the urban management members, to promote the urban management department to manage the urban management members more effectively, and to promote the urban management and development. Through analyzing the basic situation and management status of urban management members in Yinzhou District of Beijing City, Shenzhen City and Ningbo City, this paper discusses the problems existing in the management of urban management team members, and analyzes the causes of the problems. On the basis of fully analyzing the management problems of urban management team members in some cities of our country at present, the reasonable countermeasures are put forward. This study selected Beijing, Shenzhen, Ningbo Yinzhou District as samples to collect relevant data. The main research methods are literature review, questionnaire survey and interview. This research involves the management system, salary and welfare, professional title promotion, training and so on. Exploring the mobility of urban management members, the lack of awareness of laws and regulations, the lack of sense of ownership have brought some influence to urban management. The countermeasures suggest that the government organs should protect the substantive rights of the extra urban management members in the aspects of system construction, and at the same time, put forward the requirements on their own level, so that the extra urban management members have more cohesion and a sense of belonging.
