【摘要】：政府購買公共服務(wù)旨在通過政府與社會(huì)的合作最大程度的增加公眾福祉,此種供給模式提高了政府效能,滿足了公眾需求。對(duì)購買范圍進(jìn)行深入的研究,便于在實(shí)踐中科學(xué)準(zhǔn)確的界定采購需求,提升政府的服務(wù)水平。通過對(duì)現(xiàn)行文本的審視,從規(guī)范形式、頒布主體、位階效力、文本內(nèi)容等角度對(duì)購買范圍進(jìn)行初步分析。通過對(duì)各地區(qū)的實(shí)踐考察可以發(fā)現(xiàn)購買服務(wù)的范圍正在逐步拓展,但是仍然面臨理論爭議和實(shí)踐困境。范圍界定應(yīng)當(dāng)理清影響因素:法律優(yōu)先與法律保留原則、政府職能、公共性與公益性等。可以對(duì)購買范圍進(jìn)行原則規(guī)定、否定列舉、肯定列舉,從這三方面對(duì)有關(guān)法律規(guī)范予以完善,同時(shí)應(yīng)健全配套機(jī)制,即從信息公開、公眾參與、專家論證等方面進(jìn)行程序規(guī)制,從培養(yǎng)社會(huì)組織、構(gòu)建綜合評(píng)估機(jī)制、完善合同監(jiān)管等方面進(jìn)行實(shí)體規(guī)制,希冀能夠科學(xué)、準(zhǔn)確的界定購買公共服務(wù)的范圍。
[Abstract]:The purpose of government purchasing public service is to increase the public welfare through the cooperation between the government and the society. This mode of supply improves the efficiency of the government and meets the public demand. It is convenient to define the purchase demand scientifically and accurately in practice and to improve the service level of the government. Through examining the current text, this paper makes a preliminary analysis on the scope of purchase from the aspects of the normative form, the subject of promulgation, the effect of rank and the content of the text. It is found that the scope of purchasing services is gradually expanding, but still facing theoretical disputes and practical difficulties. The definition of scope should clarify the influencing factors: the principle of legal priority and legal reservation, the function of government, publicity and commonweal. We can stipulate the scope of purchase in principle, negate enumeration, affirm enumeration, perfect the relevant laws and regulations from these three aspects, at the same time, we should perfect the supporting mechanism, that is, to regulate the procedure from the aspects of information publicity, public participation, expert argumentation, etc. From the aspects of training social organizations, constructing comprehensive evaluation mechanism, perfecting contract supervision and other aspects of substantive regulation, we hope to scientifically and accurately define the scope of purchasing public services.
