國家公務(wù)員誠信體系構(gòu)建研究

【摘要】:契約化實(shí)質(zhì)上就是把被認(rèn)定為誠信的原則和標(biāo)準(zhǔn)不斷運(yùn)用于實(shí)踐的過程,規(guī)范各方責(zé)任、彰顯權(quán)利歸屬、理順應(yīng)盡義務(wù)構(gòu)成了契約化的支柱元素。國家公務(wù)員是政府的代表,也是政府與社會(huì)、社會(huì)大眾確立的成文或不成文契約的實(shí)際執(zhí)行者。國家公務(wù)員在“履約”時(shí)能否遵章守法,立誠守信,顧及公序良俗,尋求契約相關(guān)各方的“最大公約數(shù)”,事關(guān)人民利益和政府形象,更直接關(guān)系到法治社會(huì)、公民社會(huì)的構(gòu)建和落實(shí)。隨著依法治國進(jìn)程的加快,權(quán)力進(jìn)一步被關(guān)進(jìn)籠子里,社會(huì)對(duì)國家公務(wù)員的綜合素質(zhì)提出了更高要求,誠信在公務(wù)員的履職和考核獎(jiǎng)懲中將發(fā)揮更大的作用。如何把誠信與促進(jìn)國家公務(wù)員依法行政,以政府誠信帶動(dòng)社會(huì)誠信就成為理論和實(shí)踐意義兼具的有益探索。本文通過對(duì)我國國家公務(wù)員誠信現(xiàn)狀的分析、中外誠信思想的提煉、國家公務(wù)員失信現(xiàn)象的表現(xiàn)以及國家公務(wù)員誠信體系構(gòu)建等論述,厘清國家公務(wù)員誠信與社會(huì)現(xiàn)實(shí)之間的辯證關(guān)系,初步構(gòu)建國家公務(wù)員誠信體系的主要內(nèi)容和具體舉措,力圖為解決各方切實(shí)關(guān)切的國家公務(wù)員失信問題提供參考。
[Abstract]:The essence of contract is that the principles and standards that are recognized as good faith are constantly applied in the process of practice, standardizing the responsibilities of all parties, showing the ownership of rights, and straightening out the obligations constitute the pillar elements of the contract. The civil servant is the representative of the government and the actual executor of the written or unwritten contract between the government and the society and the public. Whether state civil servants can abide by the regulations and abide by the law, be honest and trustworthy, take into account the public order and good customs, and seek the "maximum common number" of the parties involved in the contract are related to the interests of the people and the image of the government, and are more directly related to a society governed by the rule of law. The construction and implementation of civil society. With the acceleration of the process of governing the country according to law, power is further put into the cage, the society has put forward higher requirements for the comprehensive quality of national civil servants, and honesty will play a greater role in the performance of duties, evaluation, rewards and punishments of civil servants. How to promote the administration of state civil servants according to law and how to promote social honesty with government honesty has become a beneficial exploration of both theoretical and practical significance. Through the analysis of the present situation of the integrity of national civil servants in our country, the refining of the honesty thought between China and foreign countries, the expression of the phenomenon of the state civil servants' dishonesty and the construction of the system of the honesty of the state civil servants, etc. This paper clarifies the dialectical relationship between the integrity of national civil servants and social reality, initially constructs the main contents and concrete measures of the system, and tries to provide a reference for solving the problem of state civil servants' dishonesty which concerned by all parties.
