論新形勢(shì)下涉及民族因素矛盾糾紛的解決思路——兼論對(duì)“兩少一寬”政策的反思

【摘要】：基于對(duì)《關(guān)于加強(qiáng)和改進(jìn)新形勢(shì)下民族工作的意見》的解讀,涉及民族因素的普通刑民事糾紛應(yīng)當(dāng)"去民族問題化",在法治軌道上進(jìn)行處理。將涉及民族因素的矛盾糾紛做"特殊"考量,在執(zhí)法或司法實(shí)踐中寬宥少數(shù)民族的做法,源于"兩少一寬"等民族政策,這不僅在合理性基礎(chǔ)上存在疑問,在實(shí)踐中也產(chǎn)生出很多問題和弊端。在全面推進(jìn)依法治國(guó)的大背景下,應(yīng)當(dāng)認(rèn)為"兩少一寬"等民族政策的歷史使命已經(jīng)完成,并樹立依法解決涉及民族因素矛盾糾紛的法治觀念。
[Abstract]:Based on the interpretation of "opinions on strengthening and improving the work of nationalities under the New situation", the common criminal civil disputes involving national factors should be "de-nationalized" and dealt with on the track of the rule of law. The "special" consideration of contradictions and disputes involving ethnic factors and the practice of condoning ethnic minorities in law enforcement or judicial practice stem from ethnic policies such as "two fewer and one lenient". This is not only questionable on the basis of rationality, In practice, there are also many problems and drawbacks. Under the background of promoting the rule of law in an all-round way, we should consider that the historical mission of "two small and one broad" and other national policies has been completed, and establish the concept of rule of law to resolve contradictions and disputes involving ethnic factors according to law.
