【摘要】：隨著全球化深度整合和對外開放戰(zhàn)略不斷推進(jìn),包括歸僑在內(nèi)的僑民數(shù)量大幅增加。保障僑民享受社會保障待遇是國民權(quán)利和基本人權(quán)的內(nèi)在要求,也是勞動力跨國合理流動的客觀需要,保護(hù)僑民社會保障權(quán)益是國內(nèi)法和國際法的應(yīng)有之義,更是政府治理現(xiàn)代化和維護(hù)國家利益的重要使命。為提高僑民社會保障便攜性、保護(hù)和實現(xiàn)僑民權(quán)益,需要完善國內(nèi)現(xiàn)有法律法規(guī)并與世界各國深度合作,加強(qiáng)相關(guān)體制機(jī)制探索,推進(jìn)落實國際法和國際公約;創(chuàng)新運行機(jī)制,拓展使領(lǐng)館或僑聯(lián)等機(jī)構(gòu)和組織的功能,合理"去政治化",聯(lián)合商業(yè)保險公司等市場手段,多種渠道保障僑民社會保障權(quán)益這一國家核心利益。
[Abstract]:With the deepening integration of globalization and the continuous promotion of the strategy of opening to the outside world, the number of expatriates, including returned overseas Chinese, has increased dramatically. It is an inherent requirement of national rights and basic human rights to guarantee the enjoyment of social security treatment for expatriates, and it is also an objective need for the rational movement of labor across the country. Protecting the social security rights and interests of expatriates is an integral part of domestic and international law. It is the important mission of the government to manage modernization and safeguard the national interests. In order to improve the portability of social security for the diaspora and protect and realize the rights and interests of the diaspora, it is necessary to perfect the existing domestic laws and regulations and to cooperate in depth with other countries in the world, to strengthen the exploration of relevant institutional mechanisms, to promote the implementation of international law and international conventions, and to innovate the operational mechanisms. We should expand the functions of embassies, consulates, overseas Chinese federations and other institutions and organizations, reasonably "depoliticize", combine market means such as commercial insurance companies, and protect the national core interests of social security rights and interests of expatriates through various channels.
