少數(shù)民族差別權(quán)的理論溯源與現(xiàn)實(shí)反思

【摘要】:少數(shù)民族權(quán)利保護(hù)的動(dòng)因緣于道德需要與政治需要,其權(quán)利屬性的雙重性決定了保護(hù)方式與實(shí)現(xiàn)方式的不同。根據(jù)西方政治哲學(xué)對(duì)平等的實(shí)現(xiàn)方式與實(shí)質(zhì)正義和形式正義的探討,民族平等的實(shí)現(xiàn)需要建立在民族差別保護(hù)制度的基礎(chǔ)上。但在制度設(shè)計(jì)與實(shí)施中,我們卻需要將民族身份與民族權(quán)利逐步予以剝離,將差別權(quán)限定在經(jīng)濟(jì)、文化等更具操作性的領(lǐng)域,以避免因集體性保護(hù)引發(fā)個(gè)體權(quán)利的分化和虛置,同時(shí)還要把握好平等的限度,以免因過度保護(hù)引發(fā)反向歧視。
[Abstract]:The motivation of minority rights protection lies in the need of morality and politics, and the duality of its right attribute determines the difference between the way of protection and the way of realization. According to the western political philosophy of the realization of equality and substantive justice and formal justice, the realization of national equality needs to be based on the protection system of national differences. However, in the design and implementation of the system, we need to separate the national identity and the national rights step by step, and define the differential authority in the economic, cultural and other more operable fields, so as to avoid the individual rights being divided and fictitious caused by the collective protection. At the same time also grasp the limits of equality, so as not to cause reverse discrimination due to excessive protection.
