【摘要】：因父母犯罪入獄服刑,服刑人員未成年子女的正常生活也因此受到影響。經(jīng)濟(jì)支持和情感慰藉部分喪失或者完全喪失使他們更容易產(chǎn)生不健康心理和社會排斥行為。他們作為一個弱勢群體需要社會給予救助,然而我國現(xiàn)有救助政策并未能很好發(fā)揮效用幫助他們走出困境和健康成長。從法律制度上來看,我國現(xiàn)行法律在服刑人員未成年子女權(quán)利保護(hù)和救助方面還處于缺位運(yùn)行狀態(tài),制度建設(shè)尚處在“無法可依”的窘境。這就導(dǎo)致了在救助過程中相關(guān)責(zé)任部門可能出現(xiàn)互相推諉,救助力度不到位等問題。另外,民間機(jī)構(gòu)在參與服刑人員未成年子女社會救助過程中因缺少法律認(rèn)可,也使得他們在對服刑人員未成年子女進(jìn)行監(jiān)護(hù)救助時處于尷尬境況。從社會福利體系來看,對服刑人員未成年子女進(jìn)行社會救助是一個現(xiàn)代國家應(yīng)盡的義務(wù)。完善的社會福利體系應(yīng)該惠及到這個群體,給予他們的救助應(yīng)該是包括物質(zhì)和心理兩方面。前者保障了他們身體的茁壯成長,后者保障了他們心理的健康成長,使他們成為身體強(qiáng)壯、心理健康、可以承擔(dān)一定責(zé)任的社會人是給予他們救助的根本目標(biāo)。本研究通過查閱相關(guān)文獻(xiàn)以及對陜西兒童村的相關(guān)人員進(jìn)行深層訪談和實地參與式觀察三種方式相結(jié)合來進(jìn)行研究,以社會工作視域?qū)υ撊鮿萑后w的生存現(xiàn)狀進(jìn)行分析,就目前現(xiàn)實狀況來說,服刑人員未成年子女存在物質(zhì)生活、教育和心理關(guān)懷三個主要方面的主需求。針對他們的社會救助政策也應(yīng)該根據(jù)他們的需求,給予全方位、多角度救助。服刑人員未成年子女社會救助政策的制定受到一定現(xiàn)實條件的約束,社會文化決定了政策的內(nèi)涵,經(jīng)濟(jì)發(fā)展水平影響政策的深入程度,與現(xiàn)有福利政策的良好銜接促進(jìn)政策的平穩(wěn)運(yùn)行,而政策受眾的需求則決定了政策制定的標(biāo)準(zhǔn)。本文在給出服刑人員未成年子女社會救助政策建議的時候強(qiáng)調(diào)以政策受眾的需求為基礎(chǔ)來制定政策,優(yōu)先滿足基本生存需求,給予適當(dāng)?shù)男睦砀深A(yù)和情感滿足,通過教育手段實現(xiàn)生存技能培養(yǎng),同時加快政策制定進(jìn)程,建立政策執(zhí)行的監(jiān)督機(jī)制,科學(xué)評估體系。就完善社會救助政策提出了以社會工作為依托的新型救助模式探索,民間機(jī)構(gòu)引入更加科學(xué)的管理和項目營運(yùn),通過專業(yè)社會工作干預(yù)手段和社會工作先進(jìn)理念,對服刑人員未成年子女進(jìn)行“增權(quán)”,打破社會刻板印象和自我刻板印象,激發(fā)他們的潛能、提升他們的能力,實現(xiàn)他們的自我價值,實現(xiàn)對這些人群更多科學(xué)和有效的救助目標(biāo)。
[Abstract]:Imprisonment for parental offences affects the normal lives of minor children. Partial or total loss of financial support and emotional comfort makes them more likely to develop unhealthy psychological and social exclusion behaviors. As a vulnerable group, they need social assistance. However, the existing rescue policies in China have not been effective enough to help them out of the predicament and grow up healthily. From the legal system point of view, the current law of our country is still in the absence of running state in the aspect of protecting and rescuing the rights of the minor children of the prisoners, and the construction of the system is still in the dilemma of "unable to abide by". This leads to the relevant responsibility departments in the rescue process may appear prevarication, rescue efforts are not in place and other problems. In addition, due to the lack of legal recognition in the process of participating in the social assistance of minor children of prisoners, civil institutions also make them in an awkward situation when they are in custody and rescue of minor children of prisoners. From the point of view of social welfare system, it is the duty of a modern country to provide social assistance to the minor children of prisoners. A sound social welfare system should benefit this group, providing them with both material and psychological assistance. The former ensures their healthy body growth, the latter ensures their mental healthy growth, and makes them become strong, mentally healthy and responsible social person is the basic goal to give them relief. Through consulting relevant documents and conducting deep interview and field participation observation of the related personnel of Shanxi Children's Village, this study analyzes the survival status of this vulnerable group from the perspective of social work. As far as the present situation is concerned, the minor children of prisoners have three main needs: material life, education and psychological care. Social assistance policies for them should also be based on their needs, give all-round, multi-angle assistance. The formulation of social assistance policy for minor children of prisoners is restricted by certain realistic conditions. Social culture determines the connotation of the policy, and the level of economic development affects the depth of the policy. The good connection with the existing welfare policy promotes the smooth operation of the policy, and the needs of the policy audience determine the standard of policy making. In this paper, when giving the policy suggestions of social assistance for minor children of prisoners, the author emphasizes that the policy should be based on the needs of the policy audience, give priority to meet the basic survival needs, and give appropriate psychological intervention and emotional satisfaction. Life skills can be cultivated by means of education, meanwhile, the process of policy making should be quickened, the supervision mechanism of policy implementation should be established, and the scientific evaluation system should be established. In order to perfect the social relief policy, this paper puts forward a new relief mode based on social work. The non-governmental organizations introduce more scientific management and project operation, through professional social work intervention means and advanced social work concept. To "empower" the minor children of prisoners, to break the social stereotype and self-stereotype, to stimulate their potential, to enhance their ability and to realize their self-worth, To achieve more scientific and effective relief for these people.
