【摘要】：工商行政管理機(jī)關(guān)作為政府主管市場監(jiān)管和行政執(zhí)法的綜合性職能部門,其職能發(fā)揮的程度,影響著整個政府職能水平的高低。以岳塘區(qū)為代表的基層工商機(jī)關(guān)作為與廣大市場主體直接聯(lián)系的工商部門重要組成部分,其履職情況直接影響著整個工商職能到位情況。黨的十八大明確了全面深化改革的重大戰(zhàn)略部署,工商部門近幾年來歷經(jīng)食品安全監(jiān)管職能劃轉(zhuǎn)、商事登記制度改革、管理體制由省以下垂直管理改為地方分級管理等重大改革。改革挑戰(zhàn)與機(jī)遇并存,市場經(jīng)濟(jì)的健康發(fā)展離不開行政執(zhí)法部門對經(jīng)營行為的有效監(jiān)管,更離不開工商部門對流通領(lǐng)域市場安全的有效監(jiān)管。縣區(qū)級工商部門在轉(zhuǎn)型改革中遇到了前所未有的挑戰(zhàn),一方面原有的工作機(jī)制不夠完善,人員結(jié)構(gòu)不盡合理,執(zhí)法權(quán)威大打折扣,另一方面要積極適應(yīng)接二連三的各項(xiàng)改革舉措。基于這樣的時代背景,結(jié)合本人在岳塘區(qū)工商部門的工作經(jīng)歷,本文對工商行政管理建制以來發(fā)展情況進(jìn)行了系統(tǒng)梳理,運(yùn)用公共管理相關(guān)理論,從促進(jìn)政府市場監(jiān)管職能到位的角度出發(fā),對岳塘區(qū)工商行政管理部門職能履行情況、存在的問題進(jìn)行了整理,進(jìn)行了深層次的原因分析。誠然岳塘區(qū)工商行政管理市場監(jiān)管自帶有歷史遺留的人員、機(jī)制、管理方法、外圍環(huán)境的影響,更為迫切的現(xiàn)實(shí)問題是,因市場監(jiān)管職能缺位導(dǎo)致的各類來自市場的事故頻發(fā),因新一輪系列改革試點(diǎn)的問題逐步浮出水面。既有前途未卜,又有后顧之憂,在這樣的內(nèi)外部環(huán)境下,岳塘區(qū)工商部門如何除舊迎新,如何破解監(jiān)管難題,成為燃眉之急。本文重點(diǎn)闡述從明確主業(yè)主責(zé),強(qiáng)化職能到位、提升監(jiān)管理念,健全工作機(jī)制、強(qiáng)隊(duì)伍建設(shè),提升工作效能、優(yōu)化工作環(huán)境,營造良好氛圍四個方面來優(yōu)化岳塘區(qū)工商行政管理市場監(jiān)管的對策,最后得出的結(jié)論是市場監(jiān)管只能加強(qiáng)不能弱化,只能更專業(yè)不能大雜燴,唯有切實(shí)將政府這只“有形的手”應(yīng)有作用發(fā)揮到位,才能確保整個市場經(jīng)濟(jì)朝著健康有序的目標(biāo)發(fā)展。
[Abstract]:As the comprehensive functional department of the government in charge of market supervision and administrative law enforcement, the degree of its function exertion affects the level of the whole government function. As an important part of the industrial and commercial department which is directly connected with the broad market main body, the basic industry and commerce organization represented by Yuetang District has a direct influence on the whole industrial and commercial function. The 18th National Congress of the Party has made clear the major strategic plan for comprehensively deepening the reform. In recent years, the industrial and commercial departments have undergone a shift in the function of food safety supervision and regulation, and the commercial registration system has been reformed. The management system changed from vertical management below provincial level to local level management and other major reforms. The healthy development of the market economy can not be separated from the effective supervision of the management behavior by the administrative law enforcement department and the effective supervision of the market security in the circulation field by the industrial and commercial departments. The industrial and commercial departments at the county and district levels have encountered unprecedented challenges in the transformation and reform. On the one hand, the original working mechanism is not perfect, the personnel structure is unreasonable, and the authority of law enforcement is greatly compromised. On the other hand, we should actively adapt to successive reform initiatives. Based on the background of this era, combined with my working experience in the industry and commerce department of Yuetang District, this paper systematically combs the development of the industrial and commercial administration system, and applies the relevant theory of public management. From the point of promoting the function of government market supervision, this paper analyzes the problems existing in the implementation of the functions of the Yuetang District Industrial and Commercial Administration Department, and makes a deep analysis of the reasons. It is true that Yuetang District's industrial and commercial administration market supervision has its own historical legacy of personnel, mechanisms, management methods, and the impact of the external environment. The more pressing practical problem is that various types of accidents from the market occur frequently due to the absence of market supervision functions. As a result of the new series of reform pilot problems gradually surfacing. Both the future is uncertain and the future is worrying. Under such internal and external environment, how to eliminate the old and welcome the new, how to solve the regulatory problems, become urgent. This paper focuses on defining the principal responsibility of the main business, strengthening the functions in place, enhancing the concept of supervision, improving the working mechanism, strengthening the construction of the team, enhancing the working efficiency, optimizing the working environment, To create a good atmosphere in four aspects to optimize the Yuetang District Industrial and Commercial Administration market supervision countermeasures, the final conclusion is that market supervision can only be strengthened can not be weakened, can only be more professional can not be mixed up. Only when the "tangible hand" of the government is put into full play, can the whole market economy develop in a healthy and orderly manner.
