【摘要】：近年來，一批又一批的不法公職人員在反腐高壓態(tài)勢下相繼落馬。其中有一部分公職人員是由于不合理的奢侈消費而身陷囹圄，，奢侈消費一時間成為部分官員的滑鐵盧。與此同時，“奢侈反腐”不僅成為公眾熱議的話題，隨之也成了新興的反腐手段�？梢�，基于反腐視角下，對公職人員的奢侈消費行為進行研究具有重大的意義。 本文基于反腐視角下，以奢侈品為出發(fā)點，通過對公職人員的奢侈消費行為進行歸類，以公職人員不法資產(chǎn)處置中的奢侈消費和職務(wù)消費異化中的奢侈消費為兩條研究主線，分別對公職人員私人領(lǐng)域和公職領(lǐng)域的奢侈消費行為進行研究，主要內(nèi)容歸納如下： 首先，本文對奢侈品的歷史演變、內(nèi)涵和外延進行了研究和總結(jié)，以此為基點引出了奢侈消費行為。然后對奢侈消費行為進行了歸類，得出公職人員的奢侈消費行為可以分為私人領(lǐng)域的奢侈消費和公職領(lǐng)域的奢侈消費，分別表現(xiàn)為不法資產(chǎn)處置中的奢侈消費和職務(wù)消費異化中的奢侈消費，為下文研究的展開奠定基礎(chǔ)，并提供研究路線和研究思路。 其次，在典型案例分析的基礎(chǔ)上，對公職人員在不法資產(chǎn)處置中的奢侈消費行為進行了分析總結(jié)。一方面得出了基于衣著首飾類、食宿房車類、娛樂活動類、社交活動類、言行愛好類、生活作風類和親屬消費類的七大監(jiān)測點，以及在監(jiān)測過程中為防止“一刀切”和“一棒子打死”的四個反腐注意點。另一方面，基于案例分析又得出了不法公職人員奢侈消費的行為特征。即消費內(nèi)容具有低端性、消費行為具有隱蔽性、消費方式具有隔離性、消費心理具有矛盾性和來源渠道具有灰色性五個奢侈消費行為特征。 再次，同樣在典型案例的基礎(chǔ)上，對不法公職人員職務(wù)消費異化中的奢侈消費進行了研究。一方面，對公職人員的職務(wù)消費異化進行了奢侈指向性的泛化，打破了傳統(tǒng)異化只是對消費額度的奢侈指向性，本文將職務(wù)消費范圍的擴大也納入了職務(wù)消費異化的范疇。另一方面，基于典型案例分析的基礎(chǔ)上得出了基于額度監(jiān)測、范圍監(jiān)測和混合監(jiān)測的反腐監(jiān)測點，也對其在監(jiān)測過程中的反腐注意點進行了歸納總結(jié)。 最后，通過對不法公職人員奢侈消費在不法資產(chǎn)處置和職務(wù)消費異化中的分類研究，提出了對不法公職人員奢侈消費行為進行監(jiān)測和控制的對策建議，希望以后能對公職人員奢侈消費行為的研究提供思路，以期能對相關(guān)部門打擊不法公職人員的奢侈消費行為提供借鑒支持。 課題資助：本文受國家自然科學基金項目《不法公職人員洗錢行為及其網(wǎng)絡(luò)拓撲結(jié)構(gòu)分析》(71273159)及教育部人文社科規(guī)劃項目《公職人員轉(zhuǎn)移非法所得的途徑與上游經(jīng)濟犯罪類型的關(guān)聯(lián)性分析》(10YJA630182)的資助。
[Abstract]:In recent years, a number of illegal public officials in the situation of high-pressure corruption has fallen. Some of them were jailed for unreasonable luxury spending, which for a time became the Waterloo of some officials. At the same time, luxury anti-corruption has become not only a hot topic for the public, but also a new anti-corruption method. Therefore, it is of great significance to study the luxury consumption behavior of public officials from the perspective of anti-corruption. Based on the angle of anti-corruption, this paper classifies the luxury consumption behavior of public officials by taking luxury goods as the starting point, taking luxury consumption in the disposal of illegal assets of public officials and luxury consumption in the alienation of duty consumption as two main lines of research. The main contents of this paper are summarized as follows: firstly, this paper studies and summarizes the historical evolution, connotation and extension of luxury goods. This led to luxury consumption behavior. Then, the luxury consumption behavior of public officials can be divided into private sector luxury consumption and public sector luxury consumption. The luxury consumption in the disposition of illegal assets and the luxury consumption in the alienation of duty consumption respectively lay the foundation for the following research and provide the research route and research ideas. Secondly, on the basis of typical case analysis, this paper analyzes and summarizes the luxury consumption behavior of public officials in the disposal of illegal assets. On the one hand, there are seven monitoring points based on clothing jewelry, room and board cars, entertainment, social activities, words and deeds and hobbies, lifestyle and kinship consumption. And in the monitoring process to prevent "one size fits all" and "a stick to kill" four anti-corruption points of attention. On the other hand, based on the case study, the behavior characteristics of illegal public officials' extravagant consumption are obtained. That is, consumption content has low end, consumption behavior is hidden, consumption mode is isolated, consumption psychology has contradiction and source channel has five characteristics of luxury consumption behavior. Thirdly, on the basis of typical cases, this paper studies the luxury consumption in the dissimilation of duty consumption of illegal public officials. On the one hand, it generalizes the dissimilation of duty consumption of public officials and breaks the traditional alienation which is only the luxury direction to the consumption quota. This paper also brings the expansion of duty consumption into the category of duty consumption alienation. On the other hand, based on the typical case analysis, the anti-corruption monitoring points based on quota monitoring, scope monitoring and mixed monitoring are obtained, and the anti-corruption attention points in the monitoring process are also summarized. Finally, through the classification of illegal public officials' luxury consumption in illegal assets disposal and duty consumption alienation, the paper puts forward the countermeasures and suggestions to monitor and control the illegal public officials' luxury consumption behavior. Hope to provide ideas for the future research on luxury consumption behavior of public officials, so as to provide reference and support for the relevant departments to crack down on the luxury consumption behavior of illegal public officials.
