政府職能轉(zhuǎn)變視角下的權(quán)力清單制度研究

【摘要】:黨的十八屆三中全會(huì)提出“推行地方各級(jí)政府及其工作部門(mén)權(quán)力清單制度,依法公開(kāi)權(quán)力運(yùn)行流程”,是為規(guī)范政府權(quán)力運(yùn)行、建設(shè)法治政府和服務(wù)型政府而采取的一項(xiàng)重大改革舉措。本文以政府職能轉(zhuǎn)變?yōu)橐暯?主要采取文獻(xiàn)法和調(diào)查研究的方法,在吸收借鑒現(xiàn)有研究成果的基礎(chǔ)上,從權(quán)力清單制度的基本理論切入,總結(jié)歸納了近年來(lái)各地各部門(mén)探索權(quán)力清單制度的實(shí)踐經(jīng)驗(yàn),深入分析我國(guó)推行權(quán)力清單制度面臨的現(xiàn)實(shí)難題和主要障礙,最后就我國(guó)全面推行這一制度提出具有針對(duì)性和可操作性的對(duì)策建議。具體來(lái)講,本文除導(dǎo)論部分對(duì)研究背景與意義、研究現(xiàn)狀與評(píng)估、研究?jī)?nèi)容與框架、研究思路與方法作整體概述,結(jié)論部分對(duì)整個(gè)研究予以概括總結(jié)之外,核心部分包括以下四章:第一章為權(quán)力清單制度的基本理論分析。本章分三個(gè)部分對(duì)權(quán)力清單制度的基本理論展開(kāi)分析:第一部分為行政權(quán)力解析,從行政權(quán)力的內(nèi)涵、來(lái)源、主要特征及其與政府職能的內(nèi)在聯(lián)系四個(gè)方面,析清行政權(quán)力的基本屬性,特別是分析了行政權(quán)力與政府職能互為依存、不可分割的內(nèi)在聯(lián)系之后,就自然導(dǎo)入本研究的主題——以政府職能轉(zhuǎn)變?yōu)橐暯莵?lái)研究政府權(quán)力清單制度。第二部分界定了權(quán)力清單制度的內(nèi)涵與、特征、主體客體、目的目標(biāo)、基本原則、制定依據(jù)等權(quán)力清單制度的基本問(wèn)題。第三部分圍繞創(chuàng)造良好發(fā)展環(huán)境、提供優(yōu)質(zhì)公共服務(wù)、維護(hù)社會(huì)公平正義三個(gè)維度,著重論述了推行權(quán)力清單制度對(duì)政府職能轉(zhuǎn)變的重大現(xiàn)實(shí)意義。第二章為我國(guó)推行權(quán)力清單制度的現(xiàn)狀分析。首先分析我國(guó)政府職能轉(zhuǎn)變進(jìn)程,爾后擇選起步較早、做法較為典型的河北、浙江、廣州三個(gè)省市作了綜述,總結(jié)了這一制度推行過(guò)程中的做法和成效,對(duì)其規(guī)律特點(diǎn)加以提煉并歸納為三種模式。同時(shí),對(duì)國(guó)家部委公開(kāi)權(quán)力清單的狀況也作了簡(jiǎn)要介紹。第三章為我國(guó)推行權(quán)力清單制度面臨的問(wèn)題障礙分析。重點(diǎn)圍繞思想認(rèn)識(shí)不到位、相關(guān)法律制度不配套、政府內(nèi)外關(guān)系未理順、權(quán)力調(diào)整中各方利益博弈突出、技術(shù)支撐不成熟等五個(gè)方面,對(duì)推行權(quán)力清單制度面臨的難題和障礙進(jìn)行了深入分析。通過(guò)上述分析,揭示出在改革步入深水區(qū)的當(dāng)下,推行權(quán)力清單制度不會(huì)一帆風(fēng)順,也不會(huì)一蹴而就,提示各級(jí)決策者看待權(quán)力清單制度不能過(guò)于簡(jiǎn)單化、常規(guī)化,而宜客觀(guān)分析、理智對(duì)待,大膽探索、依法推進(jìn)。第四章為我國(guó)推行權(quán)力清單制度的對(duì)策建議分析。對(duì)照前一章關(guān)于問(wèn)題與障礙的分析,重點(diǎn)圍繞轉(zhuǎn)變涉權(quán)各方思想觀(guān)念、配套健全相關(guān)法律制度、進(jìn)一步理順政府內(nèi)外關(guān)系、破解各方利益博弈格局、完善相關(guān)技術(shù)支撐等五個(gè)方面,結(jié)合一些典型經(jīng)驗(yàn)提出有針對(duì)性的對(duì)策建議。本文認(rèn)為,影響我國(guó)治理體系與治理能力現(xiàn)代化的一個(gè)主要障礙就是權(quán)力運(yùn)作的封閉性與模糊性。各級(jí)政府應(yīng)在憲法和法律的授權(quán)下做該做的事情,放掉不該擁有的職權(quán),促進(jìn)政府職能回歸本位,使市場(chǎng)真正發(fā)揮資源配置的決定性作用,推進(jìn)社會(huì)組織、公民依法自治進(jìn)程,最終形成符合中國(guó)國(guó)情和現(xiàn)代政府建設(shè)規(guī)律的政府職責(zé)體系。因此,必須把權(quán)力清單制度置于我國(guó)全面深化改革的時(shí)代背景中和政府職能轉(zhuǎn)變的視角下去認(rèn)識(shí)和理解,通過(guò)建立和推行權(quán)力清單制度,明確政府與市場(chǎng)、社會(huì)和公民互動(dòng)過(guò)程中的職責(zé)與邊界,使四者在未來(lái)國(guó)家和社會(huì)治理中依法扮演好各自的角色。行政體制改革作為政府的一場(chǎng)“自我革命”,期間充滿(mǎn)困難、阻力與挑戰(zhàn),必須注意改革的系統(tǒng)性、關(guān)聯(lián)性和協(xié)同性,確保權(quán)力清單制度全面有效推行。
[Abstract]:In the third Plenary Session of the 18th CPC Central Committee, the party put forward "the implementation of the power list system of local governments at all levels and their work departments and the operation process of power in accordance with the law". It is a major reform measure to regulate the operation of government power and build a government under the rule of law and a service-oriented government. On the basis of absorbing the existing research achievements and drawing on the basic theory of the power list system, this paper summarizes the practical experience of exploring the system of power list in various parts of the country in recent years, and deeply analyzes the difficult problems and main obstacles in the implementation of the system of power list in our country. Finally, we carry out this one in an all-round way. The system puts forward the countermeasures and suggestions that are pertinent and maneuverable. Specifically, this paper, in addition to the introduction to the research background and significance, the research status and evaluation, the research content and framework, the research ideas and methods as a whole, the conclusion part summarizes the whole research, the core part includes the following four chapters: the first chapter is the power. The basic theory of the list system is analyzed in this chapter. This chapter analyzes the basic theory of the power list system in three parts: the first part is the analysis of the administrative power, from four aspects of the connotation, source, main features and the internal relations with the government functions, and the analysis of the administrative power and the analysis of the administrative power and the analysis of the administrative power. After the government functions are interdependent and inseparable, they naturally introduce the subject of this study - the change of government functions as the perspective to study the system of government power list. It reveals that the implementation of the power list system will not be smooth and easy to achieve at the moment when the reform enters the deep water area. It suggests that the policy makers at all levels should not be too simple and conventional to look at the power list system, but should be objective analysis, rational treatment, bold exploration and the promotion of the law. The fourth chapter is the Countermeasures for the implementation of the power list system in China. On the basis of the analysis of the problems and obstacles in the previous chapter, we focus on the transformation of the ideas of the parties involved in the power involved, the complete set of relevant legal systems, the further rationalizing of the internal and external relations between the government, the solution of the game pattern of the interests of all parties, and the improvement of the relevant technical support, and some typical experiences and suggestions are put forward in this paper. The paper argues that a major obstacle to the modernization of governance and governance in China is the closeness and fuzziness of power operation. Governments at all levels should do what should be done under the authorization of the Constitution and law, release the functions and powers that should not be owned, promote the return of government functions, and make the market truly play a decisive role in the allocation of resources. To promote social organization and citizens' self-government process in accordance with the law of China, it will eventually form a government responsibility system which is in line with the national conditions of China and the law of modern government construction. Therefore, it is necessary to recognize and understand the power list system in the perspective of the times and the transformation of government functions, and to establish and carry out the system of power list. Define the responsibilities and boundaries of the interaction between the government and the market, the society and the citizens, and make the four play their respective roles in the future state and social governance. As a "self revolution" of the government, the reform of the administrative system is full of difficulties, resistance and challenge, and must pay attention to the systematicness, relevance and synergy of the reform, and the right to ensure the reform. The force list system is fully and effectively implemented.
